Zinātība aizliegto vienošanās aspektā

Abstract

Maģistra darba mērķis ir izpētīt zinātības nodošanas līgumu noteikumu, kas ir saistīti ar zinātības aizsardzību, mijiedarbību ar aizliegto vienošanās aizliegumu grupu atbrīvojumu ietvaros, tādā veidā noskaidrojot šādu līgumu noteikumu vērtējuma problemātiku aizliegto vienošanās aspektā. Lai sasniegtu maģistra darba mērķi, darbā ir izpētīts zinātības regulējums un izpratne Latvijas Republikas un Eiropas Savienības konkurences tiesībās, apskatīta aizliegto vienošanās koncepcija un apzināti zinātības nodošanas līgumu noteikumi grupu atbrīvojumu ietvaros. Darba rezultātā autore norāda uz zinātības institūta izpratnes un regulējuma nepilnībām, ierosina šo nepilnību novēršanas iespējas, kā arī sniedz detalizētu zinātības aizsardzības noteikumu, kas iekļauti tās nodošanas līgumos, vērtējumu aizliegto vienošanās aspektā. The aim of the master's thesis is to explore interaction between provisions, which are related to the protection of know-how, of know-how transfer agreements and restrictive practices, thereby determining issues of the assessment of following provisions in the aspect of restrictive practices. To achieve the aim of the master's thesis, there are regulation and comprehension of know-how in the competition law of the Republic of Latvia and Eurpean Union explored, the conception of restrictive practices viewed and provisions of know-how transfer agreements within block excemption identified. In the result, authoress points out faults in the comprehension and regulation of the institute of know-how, initiates options to prevent these faults, and gives detailed rating of provisions, related to the protection of know-how, of know-how transfer agreements in the aspect of restrictive practices.
