Īpatnības inženierbūvju būvniecības procesā

Abstract

Maģistra darbā „Būvniecības īpatnības inženierbūvju būvniecības procesā” ir pētīta inženierbūvju būvniecības procesa kārtība, tā atšķirības no ēku būvniecības procesa, kā arī izņēmumi no vispārīgā būvniecības procesa, veicot inženierbūvju būvniecību. Maģistra darba mērķis ir noskaidrot tiesiskā regulējuma nepilnības inženierbūvju būvniecības procesā, sniedzot iespējamo situācijas risinājumu. Darbā nonākts pie secinājumiem, ka pastāvot noteiktiem apstākļiem arī privātpersona, var veikt energoapgādes objektu ierīkošanu sarkano līniju ietvaros, uz svešas zemesgabala, bez saskaņojuma ar zemesgabala īpašnieku, un energoapgādes komersants nevar atsaukties uz tiesiskās paļāvības principu, ja ir celta prasība par būvatļaujas apstrīdēšanas vai pārsūdzēšanas termiņa atjaunošanu, ja nav ticis ievērots sabiedrības informēšanas pienākums. Maģistra darbā aplūkota gan Augstākās tiesas, gan Administratīvās rajona/pilsētas tiesas un Administratīvās apgabaltiesas prakse saistībā ar inženierbūvju būvniecības procesa tiesisko regulējumu, pievēršot pastiprinātu uzmanību energoapgādes objektu būvniecībai. The Master Thesis "Construction Peculiarities in the Construction Process of Engineering Structures" examines the legal framework of the construction of engineering structures and exceptions to the general construction process when carrying out the construction of engineering structures. The aim of the Master Thesis is to determine legal framework problems of engineering structure construction process, providing the possible solution for the situation. The research has lead to a conclusion that in certain circumstances a private individual can install a power supply object within the red lines of someone's land without coordinating with the owner and the power supply merchant cannot refer to the legitimate exception principle if there is a claim about the renewal of the challenge or appeal of building permit term and if the duty of informing the community has not been observed. The Master Thesis examines both the practice of the Supreme Court and the Administrative district/municipal court, as well administrative regional court regarding the legal framework of the engineering structures, giving special consideration to the construction of power supply objects.
