Sabiedrības attieksme pret viendzimuma attiecību reģistrāciju un laulībām

Abstract

Homoseksuālu personu attiecības un to juridiska atzīšana ir aktuāls un vairākkārt aktualizēts temats, kas raisa asas diskusijas ne tikai Latvijā, bet arī visā pasaulē. Eiropas Savienībā arvien vairāk valstis atzīst homoseksuālu personu attiecības kādā no to juridiskajām formām, taču Latvijas valsts izmaiņas šajā jomā tā arī nav piedzīvojusi. Darba mērķis ir sabiedrības attieksmes pret viendzimuma attiecību reģistrāciju un laulībām un viedokļa izmaiņu šajā jautājumā laika periodā no 1918.gada līdz mūsdienām izpēte. Darba uzdevumi ir noskaidrot sabiedrības viedokļa izmaiņas un kas to ietekmē, izzināt šī brīža situāciju Latvijas sabiedrībā un to, vai esošās tiesību normas spēj nodrošināt ģimenes tiesību aizsardzību, kā arī paredzēt iespējamās izmaiņas nākotnē gan sabiedriskajā apziņā, gan valsts tiesiskajā regulējumā. Autore atklājusi, ka, par spīti sociālajai realitātei, kur ģimenes jēdziens ieguvis plašāku tvērumu, tiesību normas arvien aizsargā tikai sākotnējo ģimenes modeli, tādejādi nesasniedzot Latvijas Republikas Satversmē garantēto ģimenes aizsardzību. Valstij ir nepieciešams koncentrēties uz sabiedrības tiesību aizsardzību un apsvērt iespēju ieviest partnerattiecību reģistrāciju.

Homosexual relationships and the legal recognition of such relationships is a topical and repeatedly actualized issue that raises heated discussions not only in Latvia, but also globally. An increasing number of European Union member states have been recognizing homosexual relationships in one of their legal forms, while Latvia has not made any progress on the matter. Aim of the diploma thesis is the study of society’s attitude towards homosexual relationship registration and marriage and changes of opinion on this matter in period since 1918 till the present day. Assignments of the diploma thesis are to determine the changes of society’s opinion and to clarify the reasons that affect them, to learn the current situation in the society of Latvia and understand, whether the legal background is capable of ensuring family rights, as well as to predict possible future changes in public consciousness and national regulation. The author revealed that, despite the social reality in which the concept of family has acquired broader boundaries, the protection of law is granted only for the original model of family, thereby unachieving the protection of family set in the Constitution of the Republic of Latvia. The state needs to focus on protection of society as a whole and consider the implementation of partnership registration.
