Viens no civilprocesa pamatprincipiem ir patiesības princips. Tas ietver tiesas pienākumu noskaidrot patiesību un civilprocesā iesaistīto personu pienākumu paust patiesību. Likumdevējs Latvijas Republikā plāno ieviest patiesības paušanas principu Civilprocesa likumā, paredzot atbildību par šī pienākuma pārkāpšanu.
Autore konstatē, ka pastāv nekonsekvence patiesību raksturojošo apzīmējumu lietojumā, un analizē tiesību doktrīnā paustos uzskatus par civilprocesā noskaidrojamo patiesību. Aplūkojot normatīvo regulējumu Latvijas Republikā mūsdienās, kā arī vēsturiskā aspektā un salīdzinājumā ar citām Eiropas valstīm, autore secina, kāda patiesība noskaidrojama civilprocesa rezultātā Latvijas Republikā, kā izpaudīsies tiesas un lietā iesaistīto personu loma patiesības principa īstenošanā, un kādu iespaidu tas atstās uz esošo civilprocesuālo kārtību, kā arī sniegs priekšlikumus tiesību normu grozījumiem, lai nodrošonātu efektīvu un korektu principa darbību. Principle of truth is one of the fundamental principles of civil procedure. It involves the court's duty to establish the truth and the duty of each person involved in civil litigation to express the truth (duty of truth-telling). The legislator of the Republic of Latvia intends to include the duty of truth-telling in the Civil Procedure Law, providing responsibility for the breach of this duty.
The author states that there is inconsistency in the use of the terms characterizing the truth and analyzes different views about the truth to be established in civil procedure expressed in legal doctrine. Analyzing the regulatory frameworks of the Republic of Latvia today, as well as in historical perspective and in comparison with other European countries, the author concludes, what kind of truth can be established as a result of civil procedure in the Republic of Latvia, describes the upcoming rules of civil procedure and the roles of the court and the persons involved in the implementation of the principle of truth, and what impact the principle will have on the existing civil procedure as well as gives suggestions to law amendments to provide correct work of the principle of truth.
