Vēlēšanu tiesību ierobežojumi parlamenta vēlēšanās

Abstract

Maģistra darbā „Vēlēšanu tiesību ierobežojumi parlamenta vēlēšanās" autors ir izvērtējis dažādus vēlēšanu tiesību ierobežojumu aspektus - to jēdzienu, regulējuma vēsturisko attīstību, izplatītākos vēlēšanu tiesību ierobežojumus un to pamatotību. Īpašu uzmanību autors ir pievērsis Latvijas Republikas Satversmes tiesas un Eiropas Cilvēktiesību tiesas judikatūrai iepriekš minētajos jautājumos. Maģistra darba mērķis ir izvērtēt vēlēšanu tiesību ierobežojumu pamatotību - gan šobrīd spēkā esošo, gan nesenā pagātnē atcelto, gan nākotnē iespējamo. Autors ir arī piedāvājis risinājumus konstatētajiem problēmjautājumiem. Darbā izmantoti dažādi tiesību avoti latviešu, angļu un krievu valodās, tai skaitā Latvijas, starptautiskie un citu valstu normatīvie tiesību akti, kā arī tiesību palīgavoti - judikatūra un doktrīna. Atslēgas vārdi: vēlēšanas, aktīvās vēlēšanu tiesības, pasīvās vēlēšanu tiesības, vēlēšanu tiesību ierobežojumi.

The author has considered various aspects of the voting right restrictions – its concept, historical development of the regulation, the most common voting right restrictions and their validity – in the Master Paper “Voting Right Restrictions in the Parliamentary Elections". The special attention is paid to the case-law of the Constitutional Court of the Republic of Latvia and the European Court of Human Rights regarding the above issues. The goal of the Master Paper is to assess the validity of the voting right restrictions effective at present and recently revoked, as well as of those possible in future. The author has also suggested solutions for the problem issues found. There are various recourses of law in the Latvian, English and Russian languages, including national and international laws and regulations and those of other countries, as well as supplementary law – case-law and doctrine used in the Paper.
