Maģistra darbā “Vispārīgās vienošanās un Iepirkuma līguma institūts publiskajos iepirkumos” autors pēta publisko iepirkumu regulējuma specifiku attiecībā uz iepirkuma līguma statusa īpatnībām, vispārīgā vienošanās un tās ietvaros slēgto līgumu īpatnībām, privāto tiesību juridisko personu, kas darbojas publisko tiesību jomā statusa un iepirkumu veikšanas īpatnības, kā arī pievērš atsevišķu uzmanību līgumiem, kuriem tiek slēgti nepiemērojot normatīvos tiesību aktos noteiktu procedūru, analizējot konkrētas valsts kapitālsabiedrības valsts mantas atsavināšanas procesu.
Par darba mērķi autors ir izvirzījis atsevišķu publisko iepirkumu institūtu izpēti un analīzi, kuras rezultātā tiek izdarīti secinājumi, kas varētu būt par pamatu šobrīd spēkā esošā Publisko iepirkumu likuma grozījumiem, kā arī jaunā publisko iepirkuma likuma regulējuma izstrādei.
Darbā tiek izmantotas dažādas pētnieciskās metodēs, piemēram, monogrāfiskā jeb aprakstošā metode – informācijas apkopošana, kas sevī ietver gan vispārīgu, gan specializētu informāciju, vēsturiskā analīze, kas sevī ietver ne tikai šī brīža redzējumu, bet arī vēsturiskās attīstības aprakstu, lai izprastu pētījuma priekšmeta galvenos attīstības posmus un konkrētā priekšmeta evolūciju un nākotnes perspektīvas. Darbā tiek pielietota arī loģiski-konstruktīvā metode, kuras ietvaros autors izdarījis secinājumus par pētījuma priekšmetu un sistēmu kopumā. Neiztrūkstoši darbā tiek izmantota arī analīzes metode, kas ir par pamatu secinājumu un priekšlikumu izdarīšanai attiecībā uz pētījuma priekšmetu, kā arī salīdzinošā metode, kas ietver pētījuma priekšmeta salīdzinājumu Eiropas Savienības dalībvalstu kontekstā un Eiropas Savienības regulējuma un nākotnes perspektīvu kontekstā. Tāpat tiek izmantota zinātniskā ārvalstu literatūra, periodika, normatīvo tiesību aktu analīze un aktuālā Iepirkumu uzraudzības biroja prakse un tiesu prakse
- In the master's paper “The institute of framework agreements and contracts in public procurements” the author analyzes the specific regulation of public procurement contract institute, framework agreements and the contracts has been awarded by rules of framework agreements, specificity of private legal entities operating in the field of public law and use of public procurement procedures, as well as paying attention to certain contracts which are awarded without the imposition of regulatory statutory procedure, including analysis of state owned company’s property expropriation process.
The target of this work is to analyze and explore the specific institutes of public procurement, aiming to draw conclusions that could be a base for amendments in Public procurement law as well as the key findings for development of new public procurement law.
In work development is used different research methods, such as monographic or descriptive method - collection of information, which includes both general and specialized information, historical analysis, which includes not only the current vision, but also the historical description of the development in order to understand the main subject of research stages of development and the evolution of a particular institute, and future prospects.
In work development also is used the logical-constructive method, in which the author has done conclusions about the research subject and the system as a whole. In the work development there is also used a method of analysis which has been the basis for making conclusions and recommendations with regard to the subject of the research, as well as the comparative method, which includes a comparison of the research subject in the context of the European Union Member States and the European Union framework and prospects for the future context. It is also used for scientific foreign literature, periodicals, laws and regulations and actual analysis of the Procurement Monitoring Bureau practice and case law
