Ļaunprātīga maksātnespēja, tās pazīmes un iespējamie risinājumi

Abstract

Bakalaura darba tēmas aktuālitāte pamatojama ar sabiedrībā plašajām diskusijām par vērienīgiem naudas izkrāpšanas mēģinājumiem, līdz ar to radot neuzticību tiesu sistēmai un tajā iesaistītajām personām. Papildus tam, tādi aizdevēji kā AS “Norvik banka”, AS “SEB banka”, AS “Swedbank”, AS “REVERTA”, kā arī AS “Danske bank” (turpmāk tekstā – Bankas) ir ieguldījušas laiku un līdzekļus, lai ļaunprātīgas maksātnespējas jautājumam pievērstu ne tikai tiesībaizsargājošo iestāžu vērību, bet arī visas sabiedrības uzmanību. Darba mērķis ir nonākt pie reāla ļaunprātīgas maksātnespējas risinājuma, kas maksimālos apjomos ierobežotu negodīgu personu naudas izkrāpšanas shēmas un veicinātu godīgas, tiesiskas un uzticamas tiesu sistēmas attīstību. Lai minētais mērķis tiktu sasniegts, tiek izvirzīti šādi uzdevumi: 1. iepazīties ar maksātnespējas pazīmēm un to, kā šīs pazīmes tiek realizētas reālās krāpšanas shēmās; 2. uzzināt naudas līdzekļu aizdevēju viedokli par minēto problēmu un to, kāds ir viņu piedāvātais risinājums ļaunprātīgas maksātnespējas apkarošanai; 3. rast risinājumu kreditoru tiesību un interešu aizsardzībai, ja kreditors iesaistīts ļaunprātīgā maksātnespējas procesā; 4. apkopojot iegūto informāciju, nonākt pie reālām normatīvo aktu korekcijām, kas mazinātu ļaunprātīgas maksātnespējas sekmēšanu. Darba tēmas izpētes noslēgumā autore nonāca pie vairākiem iespējamiem problēmsituāciju risinājumiem, atsaucoties gan uz minētās jomas speciālistu sniegto viedokli, gan uz jau reāli pastāvošām maksātnespējas procedūrām, kuras sekmīgi darbojas ārvalstīs.

Topicality of the Bachelor’s thesis is building on a comprehensive public debate about ambitious money fraud attempts thereby creating mistrust to the judicial system and the parties concerned. In addition, lenders such as AS “Norvik Bank”, AS “SEB Bank”, AS “Swedbank”, AS “REVERTA”, as well as AS “Danske bank” (hereinafter referred to as the Bank) have contributed extra time and money in order to draw attention to the malicious insolvency issue not only of the law enforcement authorities, but also the entire society. The objective is to arrive at real solution of the malicious insolvency, which would limit to utmost the money fraud schemes of unfair persons and promote development of fair, legal and reliable judicial system. In order to achieve this objective, the following tasks are set: 1. To become acquainted with the malicious insolvency features, and how these features are implemented in real fraud schemes; 2. To find out the view of money lenders regarding this problem and what is their proposed solution to combat malicious insolvency; 3. To find a solution for the protection of the creditors’ rights and interests, if the creditor is involved in malicious insolvency proceedings; 3. By summary of the information obtained, to arrive at real adjustments of regulatory enactments, which would reduce the facilitation of malicious insolvency. At the end of research of the thesis topic, the author has come up with several potential solutions of problem situations with reference both to the opinion provided by the specialists of the said area and the already existing insolvency procedures, which successfully operate abroad.
