Bakalaura darba temats ir „Cilvēktiesību garantēšanas princips pirmstiesas kriminālprocesā”.
Darba mērķi ir izpētīt normatīvajos aktos noteikto cilvēktiesību garantēšanas principu un tā nodrošināšanas mehānismus, kā arī Latvijas Republikas tiesu, Eiropas Cilvēktiesību tiesas, tiesībsarga un izmeklēšanas tiesneša lomu cilvēktiesību ievērošanas uzraudzībā un nodrošināšanā.
Darba mērķa sasniegšanai tiek izmantoti nacionālie tiesību akti un Latvijai saistošie starptautiskie cilvēktiesību dokumenti, kuri regulē pirmstiesas kriminālprocesa norisi, tā pamatprincipus un personai garantētās cilvēktiesības, kā arī dažādu autoru viedokļi un Latvijas Republikas tiesu, Eiropas Cilvēktiesību tiesas un tiesībsarga atziņas cilvēktiesību garantēšanas jautājumos.
Darba rezultātā autore izdara secinājumus par cilvēktiesību garantēšanas un ierobežošanas galvenajiem nosacījumiem, kas ir jāievēro amatpersonām veicot izmeklēšanas darbības un piemērojot procesuālos piespiedu līdzekļus, kā arī izsaka priekšlikumus normatīvā regulējuma pilnveidošanai, lai pilnveidotu personas cilvēktiesību aizsardzību. The topic of the Bachelor's paper is "The Principle of Guaranteeing Human Rights in Pre-trial Criminal Proceedings"
The goals of the paper are to research the principle of guaranteeing human rights and its ensurance mechanisms, that is specified in laws and regulations of Latvia, as well as the role of the courts of the Republic of Latvia, European Court of Human Rights, ombudsman and the investigating judge in the supervision and ensurance of respect for human rights.
To achieve the goals of the paper, the author uses national legal acts and international human rights documents relevant to Latvia, that oversee the progress of pre-trial criminal proceedings, its guiding principles and the guaranteed human rights, as well as the opinions of multiple authors and the conclusions of the courts of the Republic of Latvia, European Court of Human Rights and ombudsmen about guaranteeing human rights.
During the writing of the paper, the author makes conclusions about the guidelines of guaranteeing human rights that the respective authorities have to follow during the investigation process and the application of procedural compulsory measures, as well as states proposals for the improvement of regulatory framework to improve the protection of human rights.
