Laulātā slēgti darījumi bez otra laulātā piekrišanas

Abstract

Darbā aplūkots laulātā slēgtu darījumu bez otra laulātā piekrišanas institūts. Darba mērķi ir: 1) izpētīt laulātā slēgtu darījumu bez otra laulātā piekrišanas regulējuma attīstību Latvijā, 2) izpētīt atslēgas varas saturu un robežas, 3) izpētīt regulējumu laulātā slēgtiem darījumiem bez otra laulātā piekrišanas gan laulāto likumiskajā mantas sistēmā, gan līgumiskajā laulāto mantas kopības un laulāto mantas šķirtības sistēmā. Mērķi tika sasniegti apskatot normatīvo regulējumu, Vietējo Civillikumu kopojumā līdz mūsdienām. Tika izpētīts atslēgas varas saturs un robežas, secinot, ka pilnvarojums darījuma slēgšanai CL 87. p. 1. d. izriet no likuma, kā arī aplūkota laulāto solidāra atbildība un tās izslēdzošie apstākļi. Tika analizēts un salīdzināts ar ārvalstīm regulējums, kas attiecas uz laulāto slēgtiem darījumiem visās laulāto mantas sistēmās.

The diploma thesis describes regulation of spouse concluded deal without other spouse agreement. Objectives are: 1) to explore Latvian regulatory developments of spouse concluded deal without other spouse agreement, 2) to explore the key power in the contents and limits, 3) to explore the regime of spouse concluded deal without other spouse agreement in the legal property system, the contractual matrimonial property system and in the togetherness marital property system. Objectives were achieved by looking at the regulation of Local Civil collection until today. Explored the key content and limits of power and concluding that the authorization of deal concluding are closed under the law( CL 87 p. 1. d.), and explored a spouse joint and several liability and its proscriptive conditions. It was analyzed and compared with foreign regulations relating to spouses concluded deal in all marital property systems.
