Kombotantu izpratne starptautiskajās publiskajās tiesībās

Abstract

Darbā vispārēji tiek aplūkots bruņoto konfliktu un kombatantu institūts. Pētījumā teorētiskā daļa tiek piemērota Ukrainas konfliktam, tādējādi kvalificējot bruņotā konflikta Ukrainā starptautisko raksturu un secīgi personu, kuras piedalās bruņotajā konfliktā statusu starptautiskajās tiesībās. Pētījuma mērķis ir vispārīgi aplūkot minētos institūtus un pēc tam tos piemērot praksē Ukrainas konfliktam. Pētījuma ietvaros autors aplūko tiesu prakses un dažādu publikāciju atziņas, kā arī risina jautājumu par vispārējās kontroles un efektīvās kontroles piemērojamību. Noslēgumā autors analizē Ukrainā iesaistīto militāro vienību statusu starptautiskajās tiesībās. The paper generaly examines the institutes of an armed conflicts and combatants. The theoretical part of the research is applicated to the conflict in Ukraine in that way classifying the international character of the armed conflict in Ukraine and persons invovled in the armed conlfict status according to international humanitarian law. The study aims to generaly look at the institutes mentioned above and afterwards apply them in practice to Ukranian conflict. During the study the author considers the case study and different publications and tries to solve the mind bugging question of application of overall and effective control. At the end of the study the author analyzes the status of Ukranian separtatist armed forces in international law.
