Satversmes Preambulas nozīme tiesību aktu interpretācijā

Abstract

Bakalaura darbā ir analizēta Latvijas Satversmes preambulas nozīme tiesību aktu interpretēšanas procesā. Darbā tiek analizēta Latvijas un citu valstu konstitūciju preambulu saturs, salīdzinot šo preambulu elementus, kā arī atklājot preambulu mērķi un jēgu. Šī tēma ir īpaši aktuāla kontekstā ar jauno Latvijas Satversmes preambulu. Bakalaura darba mērķis ir izpētīt konstitūciju preambulas un izanalizēt, kāda ir to loma tiesību normu interpretēšanas procesā. Darbā autors secina, ka preambulai piemīt ne tikai deklaratīva funkcija, bet arī juridiska funkcija, kas tiešā veidā ietekmē to, kā notiek tiesību aktu interpretēšana. Turklāt preambula kopā ar pārējo konstitūcijas daļu veido vienu veselumu, tās papildina viena otru, līdz ar to tā jāpēta kopsakarā ar pārējo konstitūcijas daļu.

In the Thesis is analyzed the importance of Latvian constitution preamble in the process of legislation interpretation. The content of constitution preamble in Latvia and in other countries is analyzed in thesis, by comparing the elements of these preambles, as well as revealing the aim of preamble and its meaning. This topic is current particularly in context with the new preamble of Latvian Constitution. The aim of the thesis is to study the preambles of constitution and analyze its importance in the process of legislation interpretation. The author of the Paper concludes, that preamble has not only declaratory function but also legal function that influences directly the process of legislation interpretation. In addition to that preamble together with the rest of constitutional part makes it complete, it supplements each other and therefore it has to be researched together with the rest of constitutional part.
