Cietušā tiesību aizsardzība izlīguma procesā

Abstract

Bakalaura darba tēma ir „Cietušā tiesību aizsardzība izlīguma procesā”. Darbs ir balstīts uz izlīgumā iesaistītās puses – cietušā – tiesību aizsardzību, interešu īstenošanu un izlīguma procesa pamatā pastāvošo taisnīguma atjaunošanas pamatprincipu. Darba autore uzskata, ka likumpārkāpēja sodīšana ne vienmēr ne vienmēr dod vislabāko vēlamo rezultātu. Darbs sastāv no ievada, trīs galvenajām nodaļām, kopsavilkuma un trīs pielikumiem. Nodaļā sniegts pētījums par izlīguma procesa būtību, tajā iesaistītajām personām, kā arī izlīguma noslēgšanas norisi un tiesiskajām sekām. Bakalaura darba mērķis ir izpētīt izlīguma nozīmi, noslēgšanas procesu un izpratni kriminālprocesā.

The topic of the Bachelor Thesis is „The victims right protection in the settlement”. Bachelor Thesis is based on the involved part – victim - right protection, implementation of interests and basic principles of restorative justice. The author considers, that with the criminal punishment not always achieve the best desired result. The bachelor consists of an introduction, three main chapters, summary and three attachments. Chapters provides a study about nature of the settlement process, involved parties, also the conclusion of the settlement process and the legal consequences.- The aim of the bachelor is to explore importance of settlement, the process of conclusion and comprehension in the criminal law.
