Patvaļīgas koku ciršanas un bojāšanas kvalifikācijas problēmas un aktualitātes

Abstract

Maģistra darba temats ir “Patvaļīgas koku ciršanas un bojāšanas kvalifikācijas problēmas un aktualitātes”. Jautājums ir aktuāls daudzās valstīs. It īpaši tajās, kuru teritoriju aizņem meži. Katram kokam kā meža vai citas teritorijas sastāvdaļai ir sava vērtība un noteiktas funkcijas. Augoši koki ražo skābekli, veido ainavu, kalpo kā celtniecības materiāls. Koki plaši tiek izmantoti amatniecībā. Pat vējā lauzti koki dod labumu dabas videi, kā mikroorganismu mājvieta. Koki ir vērtīgi gan katram indivīdam, gan sabiedrībai kopumā. Koku ciršanas process tiek regulēts, bet ja noteikumi tiek pārkāpti, tad pārkāpējam var iestāties kriminālatbildība saskaņā ar Krimināllikuma 109.pantu.Darba mērķis ir izpētīt patvaļīgas koku ciršanas un bojāšanas sastāva subjektīvās, objektīvās un kvalificējošās pazīmes, analizēt dažāda līmeņa tiesu spriedumus, kuros piemērots Krimināllikuma 109.pants, kā arī izskatīt citu valstu regulējumu šajā jautājumā. Maģistra darba pirmajā nodaļā tiek izskatīta patvaļīgas koku ciršanas un bojāšanas vēsturiskā regulējuma attīstība Latvijas teritorijā. Darba autore salīdzina vēsturiskos regulējumus ar mūsdienu regulējumu. Otrā un trešā nodaļa ir veltīta noziedzīgā nodarījuma sastāva pazīmju analīzei. Savukārt ceturtajā nodaļā darba autore izskata citu valstu regulējumus par patvaļīgu koku ciršanu un bojāšanu. Topic of the master’s thesis is “Qualification problems of arbitrary tree cutting and damaging”. This is an important issue in many countries. Especially in those, where forests cover big part of the land. Each tree is a part of the forest or other territory (e.g. park) and has its own value and functions. Trees produce oxygen, are being a part of the scenery, and are the oldest building material. Wood is also very popular craft material. Not only growing trees are important. Fallen trees have many purposes. For instance, a fallen tree can be a home for huge number of microorganisms. Moreover, these are only few examples of how people use trees nowadays. This shows that trees are significant not only for individuals, but also for society in general. Laws regulate the process of tree felling. However, if a person fails to comply with said regulations, then there is article 109 of criminal law, which criminalizes arbitrary cutting and damaging of trees. The goal of this thesis is to do a research on subjective and objective features of arbitrary cutting and damaging of trees, analyze courts decisions, where article 109 of criminal law is used, and see how other countries regulate this issue. First chapter of master’s thesis is dedicated to historical development of regulation of crimes against forestry in Latvia. Author does a comparison of old regulations with the ones that are in force now. The second and the third chapters are devoted to analysis of article 109 of criminal law. Lastly, in chapter number four there is an overview of regulations on arbitrary felling and damaging of trees in other countries.
