| dc.description.abstract | Darba autore apskata anglo-sakšu trasta institūtu, to attīstību un definējumu, un Latvijas Republikas regulējumu uzticības operāciju (trastu) jomā.
Darba gaitā autore secina, ka Latvijas Republikas kredītiestādēs piedāvātas uzticības operācijas (trasti) neatbilst anglo-sakšu trasta pazīmēm, ka mūsu sniegtajiem pakalpojumiem šajā sfērā ir kā fiduciārām darījumam, tā arī trastam līdzīgas pazīmes.
Autore piedāvā ieviest protektora institūtu, kas dos klientiem papildus aizsardzību, kā arī veikt labojumus pastāvošajā uzticības operāciju (trasta) regulējumā, ieviešot izmaiņas FKTK noteikumos un Civillikuma Lietu tiesību daļā apakšnodaļu par trasta tiesībām, kā arī autore izsaka nepieciešamību ratificēt 1985.gada 1.jūlija Hāgas konvenciju par trastiem piemērojamām tiesībām un to atzīšanu.

| dc.description.abstract | The author reviews the Anglo-Saxon trust, its development and definition and Latvian Republic trust operation regulation.
The author concluded that trust operations (trusts) that are offered in Latvian Republic credit institutions do not comply with the Anglo-Saxon trust core elements, and that the services that are being offered in this field have as fiduciary relationship elements, as well as trust elements in it.
The author offers to use such an institution as protector that will give additional protection for the clients. The author offers to amend the existing trust operation (trust) regulation, by introducing changes to the FCMC regulation and by introducing a chapter in the Civil Law about trust rights. The author also expresses the need to ratify the Hague Convention of 1 July 1985 on the Law Applicable to Trusts and on their Recognition.
