dc.description.abstract | Maģistra darba mērķis ir izpētīt Padomes 2012.gada 12.decembra Regulas Nr.1215/2012 par jurisdikciju un spriedumu atzīšanu un izpildi civillietās un komerclietās regulējumu eksekvatūras procedūras atcelšanas apstākļos, pastiprinātu uzmanību pievēršot tieši regulējumam ārvalsts tiesu nolēmumu izpildes procesā un tam kā regulas prasības palīdz īstenot Civilprocesa likuma normas. Darbā aplūkotas regulas piemērošanas robežas un problemātika, kas šajā jautājumā sastopama tiesu praksē, kā arī noteikta piemērošanas robežu nepareizas izpratnes ietekme uz ārvalsts tiesu nolēmumu izpildes procesu. Veicot regulas normu analīzi, secināts, ka Civilprocesa likuma regulējums ne vienmēr saskan ar eksekvatūras procedūras atcelšanas mērķi un palīdz panākt ātru un efektīvu ārvalsts tiesu nolēmumu izpildes procesu. Kopsavilkumā papildus secinājumiem, piedāvāti priekšlikumi Civilprocesa likuma papildinājumu, kā arī praktisku risinājumu veidā, pastāvošo un nākotnē iespējamo problēmu novēršanai.

dc.description.abstract | Master's thesis is to research the Regulation Nr.1215/2012 of the European Parliament and of the Council of 12 December 2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters for the abolition of exequatur procedure conditions, paying increased attention to emphasis on regulation of foreign court decisions in enforcement proceedings, and how the requirements of the regulation helps the implementation of the Latvian Civil Procedure rules. In this work there are also inspected limits of application of the Regulation, and concerns on this issue found in judicial practice, as well determined incorrect understanding of the impact of application of the Regulation of foreign judicial enforcement process. Regulation norms analysis concluded that the Civil Procedure Law regulation is not always consistent with the purpose of exequatur proceedings cancellation and helps to achieve rapid and effective enforcement of foreign judgments execution of the adjudication process. In summary, in addition to the findings, there are presented proposals for the Latvian Civil Procedure Law in form of supplements, as well as practical solutions for prevention of existing and potential future problems.
