Vēsturiski, valstis ir apņēmušās aizsargāt savu pilsoņu tiesības – piemēram, no spīdzināšanas vai ekspluatācijas – un citu valstu pilsoņu tiesības, kuri ieceļo valstī likumīgi. Starptautiskās tiesības paredz bēgļu aizsardzību valstī, kurā tie ieceļo, ja cita valsts to liegusi.
Taču šis pētījums ir saistīts ar citu kategoriju: migrantiem, kuri nav bēgļi un patvēruma meklētāji un kuri ir citā valstī bez tās valsts piekrišanas. “Neregulārie migranti” attiecas uz tiem ārzemniekiem, kuri nelikumīgā veidā iekļūst valstī, tas ir, bez derīgiem ceļošanas dokumentiem. Bieži vien šāda veida migrācija ir nepieciešamība, nevis izvēle, jo valstī, no kuriem neregulārie migranti nāk, pastāv grūtības nodrošināt ģimeni un veicināt attīstību. Uzņemošās valstis sliecas uztvert viņus kā nelegālos imigrantus, kuri valstī atrodas nelikumīgi un kuru uzturēšanās šādā veidā jānovērš pēc iespējas ātrāk. No cilvēktiesību viedokļa, migrantiem ir tiesības uz aizsardzību saskaņā ar starptautiskajiem tiesību aktiem, neatkarīgi no to statusa saskaņā ar nacionālo tiesību aktiem. Taču praksē šādi ieceļotāji tiek uzskatīti par noziedzniekiem to sākotnējā izpratnē, proti, viņi dzīvo ārpus likuma un veidos, kādi tiks aprakstīti šajā pētījumā.
Šī darba mērķis ir izpētīt nelikumīgās migrācijas tiesisko regulējumu Eiropas Savienības ietvaros, kā arī augstāku institūciju uzraudzību (ANO un Eiropas Savienības Padome), un nelikumīgā situācijā nonākušo migrantu cilvēktiesību ievērošanas problemātiku. Lai to izdarītu, šajā darbā tiek pētīti Eiropas Cilvēktiesības tiesas spriedumi, Eiropas Savienības tiesas prakse un arī nevalstisko organizāciju prakse.
Šī darba problemātika slēpjas tiesiskā regulēja trūkumā, kas skaidri noregulētu nelikumīgā situācijā nonākušo migrantu cilvēktiesības Eiropas Savienībā. Pētījuma ietvaros tiek aplūkotas visbiežāk pārkāptās cilvēktiesības nelikumīgās migrācijas ietvaros un kā valstis tās risina. Historically, the State has pledged to protect the rights of its citizens at home – for instance from torture or from exploitation – and of citizens of other states who enter the country lawfully. Where refugees flee persecution at the hands of their own state, international law requires other states to provide the protection denied at home. This research deals with another category: migrants who are not refugees or asylum seekers and who are in another country without the state`s consent. “Irregular migrant” refers to non-citizens who have no valid leave to enter and / or remain within a state. The countries from which they come often see this as migration out of necessity, not choice, and also as the source of remittances which support families and contribute to development. “Host” states tend to see them as non-citizens who are illegally in the country, and should be removed at the earliest opportunity. From a human rights perspective, migrants are entitled to protection under international law, regardless of any irregularity under international law. In practise, many irregular migrants are in fact outlaws in the original sense of that term: they live outside the law, and outside its protection, in ways which are described in this research.
The aim of this bachelor`s thesis is to examine the legal framework of irregular migration within European Union, which include the supervision of the higher institution (the United Nations and the Council of the European Union), and of respect for the human rights of irregular migrant main problems. To do this, in this work we are exploring the European Human Rights Court judgments, the European Union and also the practise of non- governmental organisations.
This is also clearly a lack of legal control of irregular migrants to regularise the situation of human rights in the European Union. This research examines the most violated human rights of irregular migration and how countries deal with them.
