Kriminālistiskās odoroloģijas atziņas odoroloģiskajā izpētē

Abstract

Zinātniskajā literatūrā ir sastopami diezgan pretrunīgi viedokli jautājumā par odoroloģiskās ekspertīzes veikšanu. Odoroloģiskā izpēte tiek veikta ar suņa-biodetektora palīdzību, kas apgrūtina ekspertu-kinologu atzinuma novērtēšanu un izmantošanu procesuālajās darbībās. Bakalaura darba mērķis ir konstatēt odoroloģiskās ekspertīzes nozīmi un trūkumus, kā arī izvirzīt priekšlikumus trūkumu risināšanai. Bakalaura darba uzdevumi ir izpētīt kriminālistiskās odoroloģijas jēdzienu un tās vēsturisko attīstību, izanalizēt odoroloģiskās ekspertīzes būtību, kā arī tās rezultātu izmantošanas iespējamību pirmstiesas procesā un iztiesāšanas laikā. Izanalizējot iegūtos rezultātus, ir secināms, ka gadījumā, ja ir stingri ievēroti visi nepieciešamie noteikumi un rekomendācijas darbam ar smaržu pēdām, ekspertu atzinumu var izmantot noziedzīgu nodarījumu izmeklēšanā un pierādīšanā. The scientific literature reflects conflicting opinions about the performance of odorology expertise. The odorology expertise is carried out with the assistance of a dog-biodetector, which complicates the evaluation of the judgement of experts-handlers and its use in procedural actions. The aim of the Bachelor's thesis is to establish an importance and weaknesses of odorology expertise and offer a solution to the problem. The objectives of the Bachelor thesis are to study the concept of criminalistic odorology and its historic development, analyse the nature of odorology expertise, as well as the possibility to use its results in pre-trial proceedings and during trial. According to the results of the analysis, it can be concluded that if all applicable laws and recommendations when working with a trail of smell have been complied with, experts' judgements can be used when investigating crime scenes and as evidence.
