Abstract

Darba autores bakalaura darbs ir par mūsdienās,pēc autores domām,aktuālu tēmu - krāpšanu. Krāpšana ir pasaulē plaši izplatīts noziedzīgs nodarījums, jo krāpties var ikviens no mums un ļoti liela daļa cilvēku to mūsdienās arī dara. Pastāv tik daudz krāpšanas veidu - gan krāpšana ar kredītiem, gan krāpšana azartspēlēs u.c. tās paveidi, kas tiks skatīti šī bakalaura darba ietvaros. Krāpšanas jautājums praksē ir sarežģīts, jo pastāv vairāki problēmjautājumi. Viens no šādiem problēmjautājumiem ir krāpšanas nodalīšana no civiltiesiska delikta, jo krāpšana parādās arī, piemēram,apdrošināšanas vai saistību tiesībās, personām slēdzot līgumus. Kā otra problēma,kas parādās praksē, ir krāpšanas norobežošana no zādzības, piesavināšanās un izspiešanas, kas arī ir noziedzīgi nodarījumi pret īpašumu. Darba autore darbā izpētīja krāpšanas būtību, tās sastāvu(visus tā elementus un pazīmes, kas tieši ir raksturīgas krāpšanai). Tāpat darba autore centās iedziļināties arī šī jautājuma izpratnē Krievijas Federācijā un Vācijā.

The bachelor paper of the author is about, according to the author, in nowadays actual topic- fraud. Fraud is in world widespread criminal offense, because cheat can anyone of us and nowadays very large proportion of people also does that. There are so many types of fraud- fraud with credit, fraud gambling and other types of fraud, which will be viewed in this bachelor thesis. Matters of fraud in practice are complicated, because there are several issues. One of these challenges is the anti-separation of civil tort, because fraud also appears, for example, in insurance of liability, when people conclude contracts. As a second problem, which appears in practice is fraud delimitation of theft, embezzlement and extortion, which is also a criminal offenses against property. The author of the work in her work studied the essence of fraud, its composition (all the elements and features that are specific just for fraud).Similarly, the author tried to go into this matter in the Russian Federation and Germany.
