Starptautisko humanitāro tiesību piemērošanas problemātika Ukrainas krīzes kontekstā

Abstract

Pētījuma mērķis ir noskaidrot humanitāro tiesību lomu un raksturu Ukrainas krīzes kontekstā. Tiek sniegts īss humanitāro tiesību izstrādes procesa vēstures apskats. Pētījuma metode ir līdzšinējo kompetento iestāžu atziņu par humanitārajām tiesību aktiem analīze saistībā ar starptautisku un nestarptautisku konfliktu intensitāti un sekām. Pētījuma galvenais mērķis ir pierādīt starptautiska militāra konflikta esamību un humanitāro tiesību pārkāpumus Ukrainas krīzes kontekstā, pamatojoties uz pieejamo iestāžu atzinumiem un publiskajā telpā pieejamo informāciju. Papildus tiek analizēta sankciju efektivitāte un apdraudējums citām valstīm.

The study’s aim is to clarify the role and nature of humanitarian law in the Ukraine crisis. A brief review of humanitarian law’s development process history is presented. The research method is analysis of the current competent authorities’ conclusions on humanitarian law in connection with international and non-international conflict intensity and consequences. The main objective of the study is to prove the existence of a internatioanl military conflict and the humanitarian law violation in the context of the Ukraine crisis on the basis of the findings of the competent authorities and on the information available in the publicē space. In addition the effectiveness of sanctions and the threat to other countries is analyzed.
