Maģistra darba tēma ir civiltiesiskā atbildība pret trešajām personām par aizskārumu, kura pamatā ir būvniecības laikā pieļautas kļūdas. Darba mērķis ir noskaidrot pastāvošo regulējumu, apzināt tā trūkumus un piedāvāt risinājumus.
Lai izpētītu civiltiesiskās atbildības regulējumu pret trešajām personām, ievērojot nesenos normatīvo aktu grozījumus būvniecības nozarē, izpētīts atbildības regulējums Būvniecības likumā, kurš bija spēkā līdz 2014.gada 1.oktobrim, un jaunajā Būvniecības likumā. Tāpat aplūkotas esoša regulējuma alternatīvas – atbildība par paaugstinātas bīstamības avota radīto kaitējumu un „strict liability” – un analizētas problēmas, ar kurām saskaras trešās personas, ja tās vēlas saņemt atlīdzinājumu par tām nodarīto kaitējumu.
Darba rezultātā tiek piedāvāts noteikt jaunu civiltiesiskās atbildības modeli – „strict liability”. Attiecībā pret trešo personu primāri atbildīgs būtu zemes īpašnieks vai būves īpašnieks, ja zeme pieder citai personai. Piedāvājot ieviest šo jauno civiltiesiskās atbildības modeli, tiek norādīts arī uz nepieciešamajiem grozījumiem Būvniecības likumā.

The aim of the work is to research existing regulations, determine its imperfections and to suggest solutions.
In order to explore regulation of third party civil liability, taking into account latest amendments in legislative acts regulation construction, Construction law which was in force until 1 October 2014 was researched, as well as the new Construction law. Also alternative solutions to this regulation of civil liability were analised, e.g., liability for abnormally dangerous activities and other strict liabilitie, and problems regarding third persons possibilities to receive compensations were determined.
As a result of this work it has been recommended to determine new model of civil liability in the construction area – strict liability. Persons that are liable against third parties would be owner of the land or owner of the building, if land owner is a different person. By proposing this model of civil liability also needed amendments in the Construction law has been offered.
