Aizliegtās vienošanās jeb karteļi ir viens no grūtāk atklājamiem un smagākajiem konkurences tiesību pārkāpumiem. Karteļu dalībnieki aizliegtās vienošanās slēpj ar visiem iespējamiem līdzekļiem, padarot karteļu atklāšanu apgrūtinošu vai pat neiespējamu. Iecietības programma ir konkurences tiesību institūts, kas sevī ietver noteikumu un kritēriju kopumu, kuru izpildot un atklājot ziņas par karteli, aizliegtās vienošanās dalībnieks apmaiņā pret informāciju, saņem konkurences uzraugošās iestādes pretimnākšanu, kas izpaužas atbrīvošanā no soda. Autores darba mērķis ir izpētīt iecietības programmas būtību un attīstību, analizēt iecietības piemērošanu Eiropas Savienības līmenī, izzināt sastopamos problēmjautājumus, kā arī analizēt to, kā iecietības programma darbojas Latvijā, kur tiesiskais regulējums nav pietiekami noteikts.
Iegūtie darba rezultāti ir, izpratne par iecietības programmas attīstības gaitu, problēmjautājumu apzināšana, tiesiskā regulējuma analīze Latvijas tiesību sistēmā un piedāvāti uzlabojumi likumprojekta “Grozījumi Konkurences likumā” 12.1 pantā. The cartel is one of the most difficult discoveries and the most serious antitrust law violations. The members of the Cartel hide the Cartel by all means necessary, thus making the detection of cartels cumbersome or even impossible. The Leniency program is a competition law institute that includes rules and criteria set by the execution and revealing knowledge of a Cartel. In exchange for the information, the member of the Cartel receives the forthcoming in the form of immunity from the competition enforcement authority. The aim of the Master’s Thesis is to research the nature and the development of the leniency program; analyze the application in the European Union level; to explore the occurring issues, as well as to analyze how the leniency program is running in Latvia, where legislation is not sufficiently defined.
The achieved results are: the realization of the process of the leniency program; the exploration of issues; regulatory analysis of the Latvian legal system and proposed improvements to the draft law "On Amendments to the Competition Law" in Article 12.1.
