Mantošanas lietu vešanas procesā ir svarīgi izprast katras iesaistītās personas lomu mantošanas procesa laikā, kā arī uz tiem gulstošos pienākumus un tiesības. Bieži vien mantošanas procesā kā viena no iesaistītajām personām ir sastopams kreditors. Neraugoties uz to, ka debitors pats personīgi ir uzņēmies saistības savas faktiskās dzīves laikā, viņam nomirstot uzņemtās saistības tomēr turpina pastāvēt un kreditoriem ir iespējams sagaidīt uzņemto saistību izpildījumu no mirušā mantiniekiem.
Bakalaura darbs „Kreditors mantojuma lietā“ sniedz ieskatu Latvijas Republikā pastāvošajā tiesiskajā regulējumā, kas nosaka kreditora tiesības iesaistīties mantošanas procesa lietu vešanā un pieteikt pretenzijas uz mantojumu, kā arī bakalaura darbs sniedz ieskatu uz kreditoru gulstošo pienākumu izpildīšanas nepieciešamību un darbību izpildes nozīmīgumu.
Autore, veicot pētījumu, nonāk pie secinājuma, ka mantojuma tiesību tiesiskajam regulējumam Latvijā ir nepieciešami grozījumi, kuri nodrošinātu kreditoru tiesību realizācijas procesa pilnveidošanu, norādot uz iespēju palielināt zvērināta notāra pilnvaras, kā arī bakalaura darbs piedāvā iespējamo grozījumu priekšlikumus. Within the process of inheritance, it is important to understand the role of each involved person in the procedure, as well as roles of those that carry any obligations and rights in regards to particular inheritance. Often as one of the parties involved in the inheritance process is a creditor. Despite the fact that commitments made by the debtor throughout his life are personal, in case of death, obligations continue to exist and creditors can expect fulfillment of these obligations from heirs.
Bachelor thesis "Creditor within the inheritance process" provides an insight into Republic of Latvia’s existing legal framework that governs creditor's rights to engage in the inheritance process by submitting and keeping a claim to a heritage as well as determines importance of activities and duties applying to creditor within the process.
The author, conducting the study concludes that the Latvian inheritance law requires amendments, which would ensure simplification of realization of creditor’s rights and separation of notary and judicial functions, as well as provide possible proposals for amendments.
