Nepilngadīgo tiesības uz ārstniecību aizsardzības kontekstā

Abstract

Bakalaura darbs „Nepilngadīgo tiesības uz ārstniecību aizgādības kontekstā” izstrādāts saskatot pretrunas normatīvajos aktos, kas regulē nepilngadīgo tiesības un viņu likumisko pārstāvju pienākumus nepilngadīgo ārstniecībā. Bakalaura darba mērķis ir izpētīt nepilngadīgo un viņu likumisko pārstāvju savstarpējās tiesiskās attiecības nepilngadīgo tiesību uz ārstniecību realizēšanā kopsakarā ar normatīvajos aktos noteiktajām ārstniecības iestādes/personas tiesībām un pienākumiem. Autore izvirzīja šādus uzdevumus mērķa sasniegšanai: izpētīt nepilngadīgo tiesības ārstniecībā, to realizēšanas iespējas aizgādības kontekstā, likumdevēja piešķirto rīcībspējas apjomu nepilngadīgajiem, likumisko pārstāvju tiesības un pienākumus, to tiesības pilnvarot trešo personu pārstāvēt bērnu viņa ārstniecības procesā, kā arī analizēt normatīvo regulējumu un ar to saistītās problēmas praksē. Veikto pētījumu un analīzes rezultātā autore konstatē būtiskas problēmas ārstniecības pieejamībā, ko izraisa nepilngadīgo pārstāvības problēmas ārstniecībā, ārstniecības pakalpojumu sniegšanā, kas saistīta ar likumdevēja piešķirto rīcībspējas apjomu, kā arī nepilngadīgā tiesībās uz privātās dzīves neaizskaramību.

Bachelor thesis „The minor’s right to medical treatment in the context of custody” designed to see contradictions in the regulatory enactments governing the rights and obligations of the legal representatives of minors him medical treatment. The objective is to examine the work of minors, their legal representatives and medical practitioners of the rights of minors mutual legal relations on the medical treatment process in conjunction with the specified institutions / personal rights and obligations in the regulatory enactments regarding medical treatment The author set the following tasks for achieving the goal: to explore the rights of minors for treatment, the legislator in the context of realising the opportunities for patronage, the capacity of minors to legal representatives, the rights and obligations of the right to authorize third parties to represent the child in his or her medical treatment process, as well as analyse regulatory framework and related problems in practice. The author of the study and analysis of medical notes as a result of the serious problems caused by the availability of medicine, medical problems associated with the provision of services, the amount of assigned capacity, as well as the right to the inviolability of private life.
