Kriminālsods un tā mērķi

Abstract

Bakalaura darba tēma: „Kriminālsods un tā mērķi”. Šis darbs sniedz ieskatu attiecībā uz kriminālsodu mērķiem, kas ir aktuāla tēma, jo Krimināllikums tika papildināts ar jauniem kriminālsoda mērķiem, kā aizsargāt sabiedrības drošību, atjaunot taisnīgumu, resocializēt sodīto personu. Pētījuma mērķis ir izpētīt, vai kriminālsoda jaunu mērķu ieviešana sekmē noziedzīgu nodarījumu samazināšanos un novērš noziedzīgu nodarījumu recidīvu. Darba uzdevums ir apskatīt un izpētīt kriminālsodu un tā mērķus, kriminālsoda attīstību Latvijā, kā laika gaitā tas ir ticis attīstīts un pilnveidots, izpētīt kriminālsoda jēdzienu un tā pazīmes, aprakstīt kriminālsoda mērķus, kriminālsoda noteikšanu, soda veidus, kas noteikti Krimināllikumā. Pētījuma gaitā tika noskaidrots, ka jaunu kriminālsoda mērķu ieviešana sekmē noziedzīgu nodarījumu samazināšanos un palīdz novērst noziedzīgu nodarījumu recidīvu. The topic of the Bachelor’s Paper is “Criminal Punishment and Its Purpose”. This Paper provides an input of criminal penalties and their purposes, which is a current topic because of the fact that the Criminal Law has been amended by prescribing also new purposes of criminal punishment how to protect the social security, re-establish justice, and resocialize a punished person. The aim of the research is to study, if the situation of introducing new purposes of criminal punishment promotes decrease in criminal offence cases and averts relapse or recurrence of criminal offences. The task of the Paper is to study criminal punishment and its purposes, the development of criminal punishment in Latvia, its development stages and improvement, research the concept of criminal punishment and its characteristics, describe purposes of criminal punishment, types of criminal punishment prescribed by the Criminal Law, and research how criminal punishment is prescribed. During the research, it was clarified that introducing new purposes of criminal punishment promotes decrease in criminal offence cases and averts relapse or recurrence of criminal offences. As the result of the Paper, the author introduces conclusions. Key words: the Criminal Law, purposes of criminal punishment, penalty.
