Tehniskās attīstības rezultātā mums ir iespēja izvēlēties izdevīgākus, ērtākus un drošākus norēķinu veidus. Tomēr esošais normatīvais regulējums nespēj aptvert visus jaunus institūtus. Līdz ar to daudzās jomās, tostarp nodokļu, rodas neskaidrības par tiesību normu piemērošanu.
Samērā jauna virtuālā valūta bitcoin var tikt izmantota darījumos kā maksāšanas līdzeklis. Tā nodrošina iespēju veikt transakcijas ātri un izdevīgi, vienlaicīgi pasargājot savas sistēmas lietotājus no konfidenciālās informācijas izpaušanas trešajām personām. Diemžēl ES līmeni nav specifiska regulējuma attiecībā uz virtuālajām valūtām. Tajā pašā laikā bitcoin tiesiskais statuss ir izšķirošs PVN piemērošanā darījumiem, kur tie ir izvēlēti par maksāšanas līdzekli.
Autors analizēja gan esošu ES regulējumu PVN un finanšu tirgus jomā, gan 20 ES dalībvalstu oficiālo nostāju, gan doktrīnā paustas atziņās par virtuālo valūtu. Tādā veidā tika iegūts pilns priekšstats par bitcoin tiesisko statusu. Analīzes rezultāti ļāva izdarīt pamatotus secinājumus par esošā regulējuma piemērošanas iespējam un par nepieciešamību pēc jauna regulējuma ES līmenī. In the result of technical development, there is an opportunity to choose less costly, more comfortable and safe payment methods. However, existing legislation does not cover all the new institutes. Therefore in many spheres including tax there are ambiguity in applying of the law.
Quite new virtual currency bitcoin can be used as a means of payment. It provides an opportunity to make transactions faster and cheaper, at the same time protecting its’ system users from confidential information disclosure to the third parties. Although bitcoin legal status is decisive in applying of VAT to the transactions where it has been chosen as a means of payment. there are no specific regulation on virtual currencies within EU.
Author has analysed current EU legislation on VAT and financial market, 20 EU Member States official position and theses on virtual currency founded in doctrine. As a result, the studies shows the clear apprehension of bitcoin legal status. The results of the analysis is concentrated in the conclusions on the possibilities of use of the current legislation and the need of a new EU regulation.
