Jēdziena "ģimenes dzīve" tvērums Eiropas Cilvēktiesību tiesas un Latvijas tiesu praksē

Ģimenes dzīve ir tādas attiecības starp personu un tās ģimeni, no kuras rodas ne tikai ētiska un morāla rakstura pienākumi un tiesības, bet arī ar likumu noteikti pienākumi un tiesības. Atkarībā no tā, kas uzskatāms par „ģimeni”, arī valstij ir pienākumi attiecībā uz šīs ģimenes dzīves aizsarzību. Līdz ar to, ir svarīgi noteikt, kādas attiecības likuma izpratnē rada ģimenes dzīvi.
Šajā darbā autore konstatē Eiropas Cilvēktiesību konvencijas 8. pantā iekļautā jēdziena „ģimenes dzīve” tvērumu un salīdzina to ar „ģimenes” un „ģimenes dzīves” jēdzienu tvērumu Eiropas Savienības tiesību aktos, kā arī analizē Latvijas Republikas tiesību aktus ar mērķi noteikt „ģimenes” jēdziena tvērumu Eiropas un nacionālajās tiesībās un izcelt šādas interpretācijas problemātiku. Family life is the relationship between a person and its family, from which stem not only ethical and moral, but also lawful obligations and rights. Depending on what is considered to be a „family”, the state also has obligations concerning protection of a person’s family life. Thus, to it is important to acknowledge what kind of relationships constitute family life for purposes of law.
In this thesis author acknowledges the scope of the notion „family life” as included in the European Convention of Human Rights and compares it to the scope of notions „family” and „family life” as included in the legal documents of the European Union, as well as analyzes laws of the Republic of Latvia in order to establish what is to be considered a „family life” in context of European and national law and to point out the problematic aspects of such interpretation.
