dc.description.abstract | Ar Lisabonas līgumu Eiropas Savienība ieguva kompetenci darboties starptautisko ieguldījumu tiesību jomā un pārstāvēt savas dalībvalstis. Tomēr tikai tagad Eiropas Savienība sāk izmantot savu jauniegūto kompetenci, drīzumā noslēdzot visaptverošu ekonomikas un tirdzniecības līgumu ar Kanādu, kurš ietvers arī nodaļu par ieguldījumiem. Tomēr pastāv zināmas bažas par to, cik veiksmīgi Eiropas Savienība izmantos savu kompetenci starptautisko ieguldījumu jomā, jo praksē pastāv dažādas neskaidrības attiecībā uz starptautisko ieguldījumu tiesību institūtiem. Lai sasniegtu darbā noteiktos mērķus, autors pēta dažādu šķīrējtiesu spriedumus attiecībā uz ieguldījumu aizsardzības standartu saturu, tostarp apskatot Eiropas Savienības tiesību mijiedarbību ar tiem. Darba izstrādē tiek apstiprināts, ka Eiropas Savienībai realizējot piešķirto kompetenci starptautisko ieguldījumu tiesību jomā nāksies saskarties ar ne mazums izaicinājumiem, lai pilnībā pārņemtu šo jomu no dalībvalstīm. | en_US |
dc.description.abstract | With the Lisbon Treaty, the European Union gained competence to operate in international investment law and to represent member states. However, only now the European Union is beginning to use its newly acquired competence and will soon conclude a comprehensive economic and trade agreement with Canada, which will also include a chapter on investment. However, there are some concerns how the European Union will use its competence in the field of international investment, because in practice there are various uncertainties with regard to international investment law institutes. In order to achieve the objectives of the work, the author explores the arbitration judgments relating to investment protection standards content, including European Union law interaction with them. Thesis is confirmed that the European Union exercising competence on international investment law will have to face a few challenges in order to fully take over this area from the Member States. | en_US |
