Ārvalstu teroristu kaujinieku definīcija un to teroristiskās darbības tiesiskā prevencija

Abstract

Ārvalstu teroristu kaujinieks nav jauns fenomens starptautiskajā terorismā. Šie indivīdi piedalās plaša mēroga bruľotajā konfliktā Irākas un Sīrijas teritorijās pievienojoties starptautiskai teroristu organizācijai Islama valsts. Terorisms ir visai nenoteikts fenomens. Daudz atšķirīgo tiesību sistēmu, politisko kustību, morālās un ētiskās saspringstības dēļ, pasaules tiesību zinātniekiem nav sanācis panākt kopīgo terorisma definīciju. Šajā pētījuma, tiek padziļināti pētīti zinātnieku mēģinājumi definēt terorismu, ar mērķi izzināt terorisma pamatelementus, ar kuru palīdzību var apkarot terorismu, konkrēti, ierobeţojot ārvalstu teroristu kaujinieku pārvietošanās brīvību pirms tie aizceļo uz Islama valsti kurā piedalīsies atbalsta sniegšanā teroristiskam grupējumam. ES ietvaros, nacionālajā līmenī, daudzās valstīs, jau tiek vai tiek apsvērtas iespējas atľemt potenciālajiem likumpārkāpējiem viľu ceļošanas dokumentus ar mērķi preventēt to izceļošanu uz Islama valsti ar mērķi atbalstīt teroristisko grupējumu.

Foreign terrorist fighter is not a new phenomenon in a worldwide terrorism. These individuals participate in an armed, wide ranged, conflict at the Iraqi and Syrian territories by joining the terrorist organisation Islamic State of Iraq and the Levant. Terrorism, as a phenomenon, is rather unclear. Due to differences between various legal systems and political movements, and on top of the all, the complications which come from moral and ethical connections with terrorism definition, there is still, neither legal, neither academic consensus regarding it. To work out the legal measures in preventing the terrorism threat posed by foreign terrorist fighters, author studies terrorism definition in advanced manner, to find out the possibilities to restrict freedom of movement for foreign terrorist fighters. Travelling documents are already being seized from these individuals in many European Union countries on a national legislation basis. It is done due to their activities being considered connected with a possible travelling to the before mentioned terrorism organisation and joining it in fighting in armed conflict.
