Tiesības uz taisnīgu tiesu ietver kā institucionālos tā procesuālos aspektus, ko vispārēji valsts nodrošina arī ar tiesu izpildītāju palīdzību. Tiesu izpildītājs, veicot savus amata pienākumus, darbojas piedzinēja interesēs, bet tajā pašā laikā, respektējot arī parādnieka tiesības. Ja tiesu izpildītājam izpildes procesā ir arī savas personīgās intereses, tas citiem procesa dalībniekiem rada tiesību aizskārumu. Ētikas kodeksa normas nosaka, ka tiesu izpildītājam ir jāatturas no profesiju apkaunojošas rīcības kā profesionālajā darbībā, tā arī privātajā dzīvē. Juristu ētikas kodeksi netiek rakstīti, tie nedarbojas un nevar tikt pilnībā saprasti bez paplašinātas tiesisko, sociālo, politisko, un ekonomisko aspektu integrēšanas juridiskajā darbībā. Tiesas ir spējīgas atrisināt ar likumiem saistītos jautājumus. Ētikas jautājumus jau pēc būtības ir praktiski neiespējami atrisināt, vienīgi pielietojot likumus vai noteikumus. Bakalaura darba mērķis ir izpētīt interešu konflikta novēršanu zvērinātu tiesu izpildītāju darbībā kā no likumiskā regulējuma, tā arī no ētiskās dimensijas puses. Bakalaura darbs sastāv no 3 nodaļām. Kopējais darba apjoms ir 66 lappuses. The right to a fair trial includes institutional as well as procedural aspects. It is generally ensured by the state with help of judicial officers. The judicial officer in carrying out their job duties represents the interests of a collector, but at the same time respecting the rights of a debtor. If the judicial officer within the enforcement proceedings also maintains his interests, this creates a violation of the rights of other parties. The Professional Code of Ethics states that the judicial officer shall refrain from misconduct that may disgrace the profession in both the professional as well as in private life. Lawyers' codes of conduct are not written; they do not work and cannot be properly understood without the extended comprehension of legal, social, political and economic aspects of rights during their implementation. The Court is created to solve the law-related issues. Ethical issues, however, is virtually impossible to be solved by merely applying laws or regulations. The aim of bachelor paper is to investigate the prevention of the conflict of interest by applying legal framework as well as ethics in its broader sense. The bachelor paper consists of 3 chapters. Full size of the bachelor paper is 66 pages.
