Medicīniska rakstura piespiedu līdzekļu piemērošanas problemātika

Abstract

Šajā bakalaura darbā ir aplūkoti problēmjautājumi, piemērojot medicīniska rakstura piespiedu līdzekļus. Pareiza un efektīva medicīniska rakstura piespiedu līdzekļu piemērošana ir pamats mērķa sasniegšanai – nodrošināt sabiedrības drošību un uzlabot personas psihiskās veselības stāvokli, taču, pastāvot nepilnībām šo līdzekļu piemērošanā, rodas dažādas tiesiskas sekas, kas negatīvi var ietekmēt gan pašu personu, gan sabiedrību kopumā. Bakalaura darba mērķis ir izpētīt esošo krimināltiesību regulējumu, kā arī tiesu praksi un tiesību doktrīnā paustos viedokļus par problēmjautājumiem medicīniska rakstura piespiedu līdzekļu institūtā. Darbs sastāv no četrām nodaļām, kurās secīgi aplūkots medicīniska rakstura piespiedu līdzekļu jēdziens un tā vēsturiskā attīstība, priekšnoteikumi, lai personai varētu piemērot medicīniska rakstura piespiedu līdzekļus, šo līdzekļu piemērošana un ar to saistītie tiesību institūti, kā arī ārvalstu tiesību sistēmu līdzīgās un atšķirīgās pazīmes. In these bachelor thesis is examined issues by applying medical coercive measures. Basis to achieve proper and effective medical coercive measures – ensure public safety and improve the person’s mental health, but having shortcomings in applying of these measures there are arising variety of legal consequences which are impacting negatively both, the person and society as a whole. Bachelor thesis aims to explore framework for the criminal justice, as well as case law and the views expressed in the legal doctrine for the issues of medical coercive institute. The bachelor thesis consists of four chapters, which consecutively research medical coercive measures concept and its historical development, the prerequisites for person that could be applied for medical coercive measures, the application of the remedies and related legal institutions, and also similar and different features of foreign legal system.
