dc.description.abstract | Juta Urža. Bakalaura darbs par tiesu neatkarību Latvijā no varas dalīšanas aspekta. Darba vadītājs: Dr.iur., prof. Sanita Osipova, Rīgā, 2015. Darbā tika izvirzīts mērķis – analizēt varas dalīšanas principu un kā tā kontekstā Latvijā tiek nodrošināta tiesu varas neatkarība no likumdevējvaras un izpildvaras. Latvija jau vairāk kā pirms 20 gadiem ir atjaunojusi neatkarību, bet joprojām sabiedrībā tiek apšaubīta tiesu neatkarība, kas ir katras tiesiskas valsts pamatā, tāpēc pētījums par to, vai valsts ir izdarījusi visu nepieciešamo, lai tiesu neatkarība tiktu nodrošināta, ir nozīmīgs un aktuāls visai sabiedrībai. Darba rezultātā autors, ņemot vērā to, ka tiesu varas neatkarība, kas izriet no varas dalīšanas principa, ir nostiprināta Latvijas Republikas Satversmē, secināja, ka likumdevējs ir centies to garantēt arī normatīvajos aktos, izveidojot stingru savstarpējo kontroli starp visām varām. Ņemot vērā, ka katram varas atzaram ir sava izpratne par tiesu neatkarību, tās nodrošināšanu, dzīvē tas nereti noved pie tiesu varas neatkarības apdraudējuma. dc.description.abstract | Juta Urža. Bachelor of law about independence of courts of Latvia from the aspect of the separation of powers. Advisor: Dr.iur., Prof. Sanita Osipova, Riga, 2015th. The aim of this work was to analyze the principle of separation of powers and how from its aspect is provided the independence of judiciary from executive and legislative power in Latvia. From reestablishing the independence of Latvia has passed more than 20 years, but still society has doubts about independence of courts which is the base for each legal system. Because of that, research on whether the country has done everything what necessary to ensure the independence of courts, is important to everyone. Author came to the final conclusion considering on that independence of courts, what come from separation of powers, is established in the Constitution of Latvia is reason why legislator has tried to guarantee it in laws by establishing strict mutual control between all powers. Considering that each branch of power has its own comprehension about independence of courts, its ensuring, in life it often leads to the treat of independence of courts. The work consists of three chapters, nine subchapters, introduction and summary. To reach author ideas he based this work on John Locke, Charles Louis de Montesquieu, K.Dislers etc. | |
