Abstract

Rihards Ķupis. Bakalaura darbs – specializēto tiesu pazīmes Latvijas tiesu sistēmā. Darba vadītājs – lekt. Mārcis Krūmiņš. Rīgā, 2015.gads. Latvijas tiesu sistēma attīstās un tiek pilnveidota. Tiek meklēti veidi, kā novērst tās nepilnības, tai skaitā arī lietu izskatīšanas ilgos termiņus. Specializēto tiesu jēdziens Latvijas tiesību teorijā nav pilnīgi svešs, jo vēsturiski arī Latvijas teritorijā šādas tiesas ir pastāvējušas. Arī šobrīd Latvijā ir vairākas tiesas, kurās var saskatīt specializēto tiesu pazīmes. Ar šo darbu autors vēlas izprast specializēto tiesu būtību, aplūkot kā šīs tiesas ir konstruētas ārvalstīs un, salīdzināt tās ar Latvijas tiesu sistēmu. Izpētot specializēto tiesu modeļus un Latvijas tiesu sistēmu, autors secina, ka līdzšinējie centieni efektivizēt tiesu sistēmu, neapzināti ir noveduši līdz pilot izmēģinājumiem specializēto tiesu ieviešanai Latvijas tiesību sistēmā. Turpinoties tiesību attīstībai, agrāk vai vēlāk tiesību sistēmā, lai saglabātu tiesiskumu valstī, radīsies neizbēgama nepieciešamība pēc specializētajām tiesām. Tādēļ ir nepieciešams savlaicīgi ievērot norādes un veikt nepieciešamos pasākumus specializēto tiesu izveidei. Darbs sastāv no 3 nodaļām, 8 apakšnodaļām, ievada un kopsavilkuma. Darbā izmantoti tādu autoru darbi, kā H. Gramckow, B. Walsh, M .B. Zimmer, kā arī S. Osipova, A. Strupišs un A. Rieba.

System of the courts of Latvia is continuously evolving and developing. There are being searched for the ways to prevent its imperfections, including caseworks with too long terms. The concept of specialized courts in Latvian legal system is not entirely unfamiliar, because historically such kind of courts has existed in Latvian territory. At present there are several visible signs of specialized courts in system of courts of Latvia. With this work the author wants to understand the nature of the specialized courts, to see how these courts are designed in foreign countries and compare them with the Latvian judicial system. By studying models of specialized courts and the system of the courts of Latvia, the author concludes that so far efforts to improve the effectiveness of the system of courts of Latvia, unconsciously have led to the first tests to import specialized courts in Latvian legal system. Continuing the development of law, sooner or later, the legal system in order to preserve the justice in the country, there will be an unavoidable need for specialized courts. That is why it is necessary to constantly follow directions and take the necessary measures to establish specialized courts. The work consists of three chapters, eight subsections, introduction and summary. In this work was used such authors works as H. Gramckow B. Walsh, M .B. Zimmer, and S. Osipova, A. Strupišs and A. Rieba etc.
