Lai uzlabotu maksātnespējas procesa norisi un administratoru darbu, Saeima pieņēma likumu “Grozījumi Maksātnespējas likumā”, kas vienlaicīgi ar citiem grozījumiem paredz noteikt maksātnespējas procesa administratoram valsts amatpersonas statusu. Tā kā maksātnespējas joma ir privāttiesību nozare un maksātnespējas administratora profesija vēsturiski attīstījusies kā privāttiesību subjekts, valsts amatpersonas statusa noteikšana izraisījusi lielu neapmierinātību administratoru vidū. Statusa maiņas rezultātā iespējama būtiska maksātnespējas procesa administratoru skaita samazināšanās. Darbam ir četras nodaļas. Pirmajā nodaļā vēsturiskā aspektā pētīta administratora profesijas attīstība un administratora loma maksātnespējas procesa nodrošināšanā. Otrajā nodaļā tiek salīdzināts administratora statuss Latvijā ar citām Eiropas valstīm. Trešajā un ceturtajā nodaļā tiek meklētas atbildes administratora statusa maiņas pamatotībai un iezīmēta ar statusa maiņu saistītā problemātika. To improve the insolvency process and work of administrators, Saeima has adopted the law “Amendments in the Insolvency Law” that concurrently with other amendments anticipate determining of status of a public official to the insolvency administrator. Since the insolvency area is an area of private law and the professional of an insolvency administrator has historically developed as a subject of private law, determination of status of public official has caused huge discontent among the administrators. In the result of change of the status, the number of insolvency administrators may materially change. The work has four chapters. The first chapter researches the development of the profession of administrators in a historical aspect and the role of an administrator in provision of an insolvency process. The second chapter compares the status of an administrator in Latvia and other European countries. The third and fourth chapter searches the answers to the justification of change of status of administrators and outlines the problems connected with the change of status.
