Bāriņtiesas kā institūcijas loma bērnu tiesību aizsardzībā

Abstract

Bakalaura darbu “Bāriņtiesa kā institūcijas loma bērnu tiesību aizsardzībā” izstrādāja Jana Horste zinātniskās vadītājas prof. Jautrītes Briedes vadībā. Bakalaura darba izstrādes rezultātā, autores skatījumā, sasniegts izvirzītais mērķis, kur tika izvērtēts bāriņtiesas darbs bērnu tiesību aizsardzības nodrošināšanā. Darbs ir izstrādāts četrās nodaļās: pirmajā nodaļā tiek apskatīta bāriņtiesu izvedošana un tās darbības principi. Otrjā nodaļā tiek apskatīta bāriņtiesas kompetence bērnu tiesību aizsardzībā, bāriņtiesas tiesības un pienākumi, kā arī bāriņtiesas faktiskā rīcība bērnu interešu nodrošināšanā. Trešajā nodaļā tiek apskatīta lēmumu pieņemšana bāriņtiesā - gan koleģiālu, gan vienpersonisku lēmumu pieņemšana, gan pēc tiesas pieprasījuma pieņemtie lemumi un to apstiprināšana tiesā. Ceturtajā nodaļā tiek apskatīta bariņtiesas sadarbība ar valsts un pašvaldību iestādēm. Nobeigumā tiek piedāvāti gala secinājumi un priekšlikumi labākai bernu tiesību aizsardzībai.

Bachelor thesis „Orphan's Court as an institution role in the protection of children's rights” developed by Jana Horste in guidance of scientific supervisor prof. Jautrīte Briede. At the result of bachelor thesis development, in the author’s opinion, the aim set is reached, where was evaluated the work of orphan's court in ensuring the protection of children's rights. Thesis is crafted in four chapters: in first chapter are viewed creation and operating priciples of orphan's court. In the second chapter are viewed competence of the orphan's court in the protection of children's rights, the orphan's court rights and obligations, as well as the orphan's court actual conduct in ensuring the best interests of children. In the third chapter are viewed decision making in the orphans court - for both collegiate, both sole decision making, both after court demand adopted decisions and their approval in court. In fourth chapter is viewed orphans court cooperation with central and local authorities. At the end are offered final conclusions and suggestions for better protection of children's rights.
