Soda noteikšanas vispārīgie un speciālie principi, jeb kritēriji pēc kuriem jāvadās tiesai, prokuroram, nosakot sodu, katrā konkrētā lietā, pastāv jau kopš pirmatnējās sabiedrības laikiem, kad sodu sistēmas pamatā bija atmaksas ētika. Šie principi ir stingri jāievēro katra soda piemērošanā konkrētai personai, sodam ir jābūt individualizētam un attiecīgi pamatotam, lai to veiksmīgi izdarītu ir jāatsaucās uz soda noteikšanas principiem. Pēc autora domām bieži vien tiesu praksē uz šiem principiem neatsaucās pietiekami detalizēti un pamatoti. General and special principles or criteria that should guide the court, the prosecutor in determining the penalty in each particular care has existed since the primitive society times when the penalty system based on principles such as talion. These principles must be adhered to each penalty application on a specific person, the penalty should be personalized and duly justified to successfully refer to the sentencing principles. According to the author these principles aren’t sufficiently detailed and justified in court.
