Izlīgums kā pamats personas atbrīvošanai no kriminālatbildības

Abstract

Izlīgums var kalpot un veicināt taisnīguma atjaunošanu un pareizāku krimināltiesisko attiecību noregulējumu. Bakalaura darba mērķis ir izpētīt izlīguma tiesiskā regulējuma attīstību, esošo izlīguma institūta regulējumu gadījumos, kad persona tiek atbrīvota no kriminālatbildības un aplūkot izlīgumu kriminālprocesa kontekstā. Darbs sastāv no četrām nodaļām, kurās tiek izpētīta atbrīvošana no kriminālatbildības izlīguma noslēgšanas gadījumā, izlīguma jēdziens un tiesiskais regulējums, izlīguma procesuālā forma un izlīgums kriminālprocesa ietvaros, kā arī sniegti priekšlikumi esošā regulējuma papildināšanai.

Settlement may serve and promote recovery of justice, and could possibly provide accuracy between criminal law adjustments. The aim for this thesis is analyze the development of a settlement as legal instrument, research an existing institute of settlement in cases when person has been released from criminal liability and research the settlement in accordance with criminal process. This thesis consists of four main parts. Release from criminal liability has been researched with regards of settlement, the concept of a settlement has been analyzed together with legal adjustments, the procedural part and legal effect of a settlement. Last, but no least, proposals have been made to complement existing legal framework.
