Bērna labāko interešu principa saturs

Abstract

Bērna labāko interešu princips ir viens no svarīgākajiem starptautiski atzītajiem instrumentiem bērnu tiesību īstenošanā un attīstīšanā. Bērns kā tiesību subjekts ir ierobežots savu tiesību autonomā realizācijā, kā dēļ tas ir atkarīgs no citu personu motivācijas izvērtēt tā tiesības objektīvi. Šī iemesla dēļ, bērna labāko interešu principa klātbūtne ikvienā jautājumā, kas skar bērnu, ir izšķiroša. Bakalaura darbā “Bērna labāko interešu principa saturs” tiek atklāta bērna labāko interešu principa nozīme bērnu tiesību realizēšanā, tā ietekmes spēks un tvērums. Darbā tiek konstatēti arī galvenie problēmjautājumi pricipa praktiskajā piemērošanā un no tā izrietošās sekas. Bakalaura darbā tiek apskatīti bērna labāko interešu galvenie starptautiskie avoti, no kuriem sīkāk tiek analizēts ANO Konvencijas par bērnu tiesībām regulējums. Darba mērķis ir izpētīt vai šis princips Latvijā tiek īstenots atbilstoši starptautiskajām saistībām.

The principle of the best interests of the child is one of the most internationally recognized legal tools of protecting and implementing the rights of the child. Child as a legal subject is limited in autonomous realization of his rights, he mostly depends on the motivation of others to interpret his rights objectively. That is the reason why presence of the principle in every action relating to a child is crucial. Bachelor’s work “ The substance of the principle of the best interests of the child” uncovers the meaning of the principle in realization of the rights of children, the strength and scope of it. The work defines the main challenges of the practical enforcement of the principle as well as the consequences of it. The main sources of the principle are examined in this work, but more detailed analyse is made on the UN Convention of the Rights of the Child. The aim of the work is to explore the international implementation of the principle to draw conclusion whether it’s done the same way in Latvia.
