Civillikums nosaka, ka uz zemes uzcelta ēka ir ar to savienota un atzīstama par tā daļu. Zemes reformas laikā vairāki normatīvie akti noteica izņēmuma gadījumu no Civillikumā pieņemtā zemes un ēkas vienotības principa. Atjaunojot nacionalizētos īpašumus, ir izveidojusies situācija, ka uz zemes gabala uzceltās ēkas pieder vienam īpašniekam, bet zeme citam īpašniekam. Tā rezultātā ir izveidojies tiesību institūts, ko sauc par dalīto īpašumu. Šajā situācijā neviena no pusēm nevar brīvi rīkoties ar savu īpašumu. No tiesu prakses var secināt, ka dalītam īpašumam ir divi veidi: piespiedu dalīts īpašums un brīvprātīgs dalīts īpašums. 2015.gadā Civillikumā ir izdarīti grozījumi, ar kuriem Civillikumā ir ieviests jauns tiesību institūts – apbūves tiesība. Apbūves tiesība (superficies) ir pazīstams jau no senās Romas valsts pastāvēšanas laikiem. Apbūves tiesība ir tiesība ir ar līgumu piešķirta mantojama un atsavināma lietu tiesība celt un lietot uz sveša zemes gabala ēku kā patstāvīgu īpašuma objektu. Latvijā atšķirībā no citām valstīm apbūves tiesība ir attiecināma tikai uz nedzīvojamu ēku vai inženierbūvi. Mūsdienās apbūves tiesības regulējums ir atrodams Igaunijas, Lietuvas, Čehijas un citu valstu likumos. Darba mērķis – analizēt apbūves tiesību regulējumu, salīdzināt piedāvāto regulējumu ar citās valstīs sastopamo. Darbā izmantotas zinātniskās pētniecības metodes: vēsturiskā, analītiskā, salīdzinošā. Darba mērķa sasniegšanai tiks risināti šādi uzdevumi: apskatīt dalītā īpašuma rašanos; apskatīt apbūves tiesību rašanās un vēsturisko attīstību; analizēt piedāvāto apbūves tiesību regulējumu Civillikumā un salīdzināt to ar citu valstu regulējumu. Latvian Civil law states that a building which is built on the land is connected to the land and is recognised as a part of it. During the land reform, legislation established a number of exceptional cases from the building and land unity principle covered in Civil law. While restoring the nationalised property, a situation can occur whereby a building is owned by one person and the land is owned by another person. As a result a legal entity called divided property exists. In this situation, none of the parties is allowed to use their property freely. From court roulings we can conude that there are two types of divided property: forced and voluntary devided property. In order to avoid forced devided property in the future, amendments have been made in Latvian Civil code, which establish a new legal institute – building rigts or superficies. Superficies as a legal institute has been know already from the ancient Roman times. Superficies is a right established by a contract or heritage to use a building built on someone else's land as an independent object of property. In Latvia compared to other countries superficies apply only to non-residential buildings or civil ingeneering buildings. Nowadays the legal framework of superficies can be found in the laws of such countries as Estonia, Lithuania, Czech Republic and others. The objective of this thesis – to analyse the legal framework of superficies and compare it to the framework of the other countries. The following scientific research methods have been used in this thesis: historical, analytical and comparative. To reach the objectives of this thesis following the following tasks were addressed: occurrance of a divided property and historical development, analysing the regulation of divided property in the Latvian Civil Code and comparing it to the regulation of other countries.
