Abstract

Izlīgums ir brīvprātīgs process, kurā iesaistītās puses cenšas panākt izraisītā konflikta abpusēji taisnīgu risinājumu, kā arī rezultāts – pušu vienošanās ar konkrētiem nosacījumiem un to izpildes kārtību. Izvēlētā temata aktualitāti atspoguļo 2014.gadā noslēgto izlīgumu straujš pieaugums un efektīva Valsts probācijas dienesta izlīguma organizēšana un vadīšana. Maģistra darba mērķis ir izpētīt un analizēt izlīguma institūta tiesisko regulējumu Latvijā, pastāvošus problēmjautājumus praksē attiecībā uz izlīgumu un to izpildi kriminālprocesā, un veikt salīdzinājumu ar citām valstīm, piedāvājot efektīvus priekšlikumus izlīguma procesa uzlabošanai.

A settlement is a voluntary process in which the parties to the conflict caused by trying to achieve a mutually fair solution, as well as the outcome - an agreement between parties under certain conditions, and their executions. The chosen theme reflects the urgency of a settlement entered into in 2014 and the rapid increase in the effective National Probation Service settlement organization and management. Master's thesis is to investigate and analyze the settlement Institute of Latvian legislation, existing challenges in practice with regard to the settlement and enforcement of criminal proceedings and to make a comparison with other countries, offering effective proposals for improving the reconciliation process.
