Zvērinātu notāru kompetenču izvertējums laulības reģistrēšanas lietās

Abstract

Maģistra darbs „Zvērināta notāra kompetenču izvērtējums laulības reģistrēšanas lietās” sniedz vērtējumu par iespējām zvērinātiem notāriem nodot laulības slēgšanas funkciju līdzās jau pastāvošajiem laulības reģistrēšanas institūtiem, proti, dzimtsarakstu iestādēm un baznīcām. Darba ietvaros tiek vērtētas minētās ieceres, lietderība, institucionālā atbilstība un ietekme Latvijas tiesību sistēmā. Darba mērķis ir izpētīt notariāta lomu un laulības institūta specifiku, izvērtējot zvērināta notāra iespējas uzņemties laulības reģistrēšanas funkciju, īstenojot tā izpildi, atbilstoši spēkā esošajam regulējumam laulības tiesību jomā, izvirzot jautājumu - vai maz nepieciešams alternatīvs laulības reģistrēšanas institūts, aplūkojot iecerē paustās sistēmas priekšrocības. Pētījuma rezultātā autore secina, ka nav nepieciešams veikt grozījumus normatīvajos aktos, paredzot alternatīvu laulības reģistrēšanas institūtu, uzskatot, ka minētā sistēma neiekļausies pašreiz spēkā esošajā regulējumā, norādot, ka līdzvērtīgu laulības reģistrēšanas norisi jau šobrīd spēj nodrošināt Dzimtsarakstu nodaļas. Tomēr, autore motivē pārskatīt liecinieku institūta lietderību mūsdienu sabiedriskās dzīves prasībām, tādējādi, iespējams, panākot vienkāršotu laulības reģistrācijas procesa norisi, paredzot izvēles iespējas minētā institūta līdzdalībai.

The title of Master’s Thesis “Evaluation of a Sworn Notary’s Competences in Marriage Registration Matters” provides the analysis of the possibility of entrusting sworn notaries with marriage registration functions in parallel with already existing marriage registration institutes, namely, registry offices and churches. Within the framework of the thesis the author has evaluated the aforesaid concepts, expediency, institutional conformity and influence within the legal system of Latvia. The goal of the thesis is to research the role of the notariate and the specifics of the marriage institute, analyzing a sworn notary’s possibilities to assume the function of registration of marriages, ensuring its fulfillment in line with applicable regulations in the sphere of the marriage law, raising a question – whether an alternative marriage registration institute is required, analyzing the system’s advantages set forth in the concept. As a result of the research the author has concluded that no amendments are required to be made to regulatory enactments, providing for an alternative marriage registration institute, believing that the system in question will not integrate into the current regulation, with an equivalent marriage registration procedure being currently ensured by registry offices. Nonetheless, the author motivates to review the suitability of the witness institute to the modern public life requirements, thus, reaching a simplified marriage registration procedure, providing for the possibility to choose the involvement of the aforesaid institute.
