Deklarācijas pie Konvencijas par starptautiskajiem preču pirkuma-pārdevuma līgumiem

Abstract

Šajā pētījumā apskatītas pie ANO Konvencijas par starptautiskajiem preču-pirkuma pārdevuma līgumiem izteiktās deklarācijas un atrunas. Starptautiskajām publiskajām tiesībām veltītajā darbā nodaļā aplūkoti atrunu un deklarāciju jēdzieni, to izteikšanas kārtība un nosacījumi, kā arī spēkā esamība un jo sevišķi Vīnes konvencijas par starptautisko līgumu tiesībām regulējums un ANO Starptautisko tiesību komisijas izstrādātais Ceļvedis darbā ar atrunām. Savukārt starptautiskajām privāttiesībām veltītā nodaļa izvērtē ANO Konvencijas par starptautiskajiem preču-pirkuma pārdevuma līgumiem nobeiguma noteikumos paredzētās deklarācijas un atrunas, apskatot katru tās veidu atsevišķi un izdarot secinājumus par to pareizu piemērošanu. Darbs tiek noslēgts ar secinājumiem par atrunu piemērotību unificētā regulējuma konvencijām.

This paper assesses the declarations and reservattions expressed to the UN Convention on Contract for the International Sale of Goods. In the chapter devoted to public international law the paper looks at the concepts of reservations and declarations, the procedure for their formulation, as well as their validity, and in particular tje Vienna Convention on the Law of Treaties and the UN International Law Commission Guide to Reservations to Treaties. Whereas the chapter devoted to private international law analysis the declarations and reservations provided for in the final provisions of the UN Convention on Contracts for the International Sale of Goods, assessing each of them separately and concluding on their correct application. The paper ends with conclusion on the suitability of reservations for uniform law conventions.
