Maģistra darba „Pārrobežu veselības aprūpes tiesiskā regulējuma piemērošanas problemātika” autore vērš uzmanību uz pieaugošo personu mobilitāti, kā rezultātā arvien aktuālāks kļūst jautājums par personu sociālo aizsardzību, pārvietojoties ES ietvaros. Darbā pētītas personu iespējas saņemt veselības aprūpes pakalpojumus citā ES dalībvalstī, EEZ valstī un Šveicē, kas tiek apmaksāti no atbildīgās dalībvalsts, kurā persona apdrošināta, budžeta līdzekļiem. Maģistra darba mērķis ir izanalizēt ES normatīvo regulējumu attiecībā uz apdrošināto personu un viņu ģimenes locekļu tiesībām uz veselības aprūpes pakalpojumu pieejamību, pārvietojoties ES teritorijā; izpētīt LR nacionālā tiesiskā regulējuma atbilstību ES prasībām; identificēt tiesiskā regulējuma piemērošanas problēmas; piedāvāt risinājumus tiesiskā regulējuma uzlabošanai. Autore plaši analizē EST judikatūru un rezultātā sniedz priekšlikumus redakcijām LR nacionālajā normatīvajā regulējumā. The author of the master thesis „Problems in application of legal framework for cross-border healthcare” outlines the increasing mobility of individuals, which raises an issue on social protection of these persons when they moving within EU. The work explores how persons can access healthcare services in the another EU Member State, EEA countries and Switzerland, which are paid from the budget of the competent Member State where the person is insured. The aim of the master thesis is to analyze the EU legal framework related to the rights of insured persons and their family members access health care services (benefits in kind) when moving within EU; to explore the compliance of the national legal framework of the Republic of Latvia to the requirements of EU legal framework; to identify problems of application of the legal framework; to make proposals for improvements of the legal regulation. The author widely analyzes the case-law of the EU and makes proposals for amendments for the legal acts of the Republic of Latvia.
