Darbā tiek aplūkoti strīdīgie momenti starp LR VID un nodokļu maksātāju atsevišķu PVN tiesību normu piemērošanā priekšnodokļa atskaitīšanā, kas rodas nodokļu audita rezultātā. Ir sniegts VID audita pierādījumu iegūšanas galveno metožu skaidrojums. Maģistra darbā tiek veikta iegūto audita pierādījumu objektivitātes analīze saskaņā ar attiecināmības un pietiekamības kritērijiem. No izveidojušās auditoru prakses viedokļa ir veikta arī atsevišķu nodokļu likumdošanas normu interpretācija, kas ievērojami ietekmē nodokļu maksātāju likumīgo tiesību realizāciju strīdos ar VID, kā arī izveidojusies LR AT prakse un pēdējās atziņas ES judikatūrā. Darba rezultāts ir apgalvojums, ka VID darba metodikas prakse ir jāpārskata sakarā ar neatbilstību ES tiesu praksei, kas noved pie vispārējo tiesību principu neievērošanas valsts savstarpējās attiecībās ar nodokļu maksātājiem. The thesis deals with controversies between the SRS of the Republic of Latvia and the taxpayers in the application of VAT rights arise as a result of the tax audit. The key points are explained about obtaining audit evidence, which is used by the SRS as a basis for making decisions. The objectivity of such evidence is assessed based on eligibility and adequacy criteria, as it directly affects the possibility of its use in legal proceedings. Discussing the techniques in terms of the auditing practices, attention is also given to certain rules of interpretation of tax laws that have a significant impact on the exercise of the legal rights of taxpayers in disputes with SRS as well as in hearing of cases brought before courts in accordance with the established practices of the Supreme Court of the Republic of Latvia and recent findings in the EU case law. Its is concluded that established methods of work of the SRS must be revised due to the nonconformity to EU practice in the application of VAT, which leads to violation of the general judicial principles in the relations of the state with the taxpayers, and ultimately to violation of the legal rights of the latter.
