Privātpersonu tiesības uz kaitējuma atlīdzību, ja kaitējums radīts ar videi bīstamām darbībām

Abstract

Ar videi bīstamām darbībām var tikt radīts kaitējums ne tikai videi, bet arī privātpersonām (personu nāve, miesas bojājumi, privātpersonu īpašumam radītie zaudējumi), taču ne vienmēr cietušās personas var saľemt par to kompensāciju. Šī maģistra darba mērķis ir izpētīt un izanalizēt starptautisko, Eiropas Savienības, ārvalstu un Latvijas normatīvo regulējumu, kā arī speciālo literatūru un tiesu praksi, kas attiecas uz atbildību par videi bīstamām darbībām, kas radījušas kaitējumu personām, kā arī par videi nodarīto kaitējumu un rast ieteikumus, kas veicinātu privātpersonu tiesību uz kaitējuma atlīdzību aizsardzību Latvijā. Maģistra darba tapšanas gaitā autore ir nonākusi pie secinājumiem arī par to, kā nodrošināt kompensāciju izmaksu cietušajiem no videi bīstamām darbībām.

Environmentally hazardous activities can cause damage not only to environment, but also to individuals (persons death, personal injury, property losses), but not always the victims can receive compensation for it. The aim for this master thesis is to explore and analyze the international, European Union, foreign and Latvian legal framework, as well as special literature and case law relating to liability for environmentally hazardous activities that have caused damage to persons, and also to environmental liability, and to find recommendations that can promote the protection of the rights to compensation, when damage has been done to individuals in Latvia. During the preparation of the master's thesis, the author has also come to the conclusions on how to ensure that compensation will be paid to victims of environmentally hazardous activities.
