Abstract

Maģistra darba tēma ir „Process par noziedzīgi iegūtu mantu”. Maģistra darba mērķis, pētot juridisko literatūru, tiesu praksi un ārvalstu regulējumu, ir noskaidrot noziedzīgi iegūtas mantas izpratni, iespējamo rīcību ar noziedzīgi iegūtu mantu un analizēt Kriminālprocesa likuma 59.nodaļu – process par noziedzīgi iegūtu mantu piemērošanu praksē un ar to saistītās problēmās kā arī piedāvāt iespējamos risinājumus. Maģistra darba uzdevumi ir izanalizēt noziedzīgi iegūtas mantas jēdzienu un izpratni, noskaidrot kāda ir iespējamā rīcība ar noziedzīgi iegūtu mantu un kādas problēmas pastāv praksē, kā arī analizēt Kriminālprocesa 59.nodaļas procesu par noziedzīgi iegūtu mantu piemērošanu praksē. Darbā autore centīsies noskaidrot vai process par noziedzīgi iegūtu mantu ir uzskatāms par sevišķo procesa veidu, to kādā veidā šajā procesā tiek iesaistīti dalībnieki un kāda ir šo personu tiesību aizsardzības efektivitāte, kā arī analizēs paša procesa norisi un izteiks savus problēmu risinājumus. Maģistra darbs sastāv no trīs nodaļām. Pirmajā nodaļā autore analizē noziedzīgi iegūtas mantas jēdzienu un izpratni. Otrajā nodaļā tiek aprakstīta iespējamā rīcība ar noziedzīgi iegūtu mantu. Trešajā nodaļā tiek analizēts process par noziedzīgi iegūtu mantu, tā norise un pastāvošās problēmas praksē, kā arī piedāvāti iespējamie risinājumi.

Master’s thesis theme is „The process of illegally acquired property”. The aim of the Master’s thesis, studying legal literature, jurisprudence and foreign law, is to find out the comprehension of illegal acquired property and possible actions with it, to analyze Chapter 59 of Criminal proceed law – process of illegally acquired property in practice and related issues, offering own solutions. Master’s work tasks are to analyze the concept of illegal acquired property, possible action with it and process of illegal acquired property. The author will try to find out if process of illegally acquired property is regarding of the particular type of process, way in which this process participants are involved and what is the protection of individual rights. As well as will analyze the trial of this process and offer solutions of problems. Masters’ thesis consists of three chapters. In the first chapter author analysis the understanding of illegal acquired property. Second chapter is describing the possible actions with illegal acquired property. And third chapter is analysing the process of illegal acquired property.
