Pamattiesību aizskārums kā neatņemama sastāvdaļa pieteikumam Satversmes tiesā

Darbā tiek pētīts pamattiesību aizskārums kā neatņemama sastāvdaļa pieteikumam Satversmes tiesā. Šī temata ietvaros autore pēta arī aizskārumu kā priekšnoteikumu pašvaldības domes pieteikumam Satversmes tiesā. Lai pilnvērtīgāk izprastu šī jautājuma teorētiskos un praktiskos aspektus, darbā tiek pētīts arī jautājums par aizskārumu kā priekšnoteikumu Eiropas Cilvēktiesību tiesā, kā arī administratīvajā tiesā Latvijā. Mērķa sasniegšanai autore izpētīja gan tiesību doktrīnu, gan arī tiesu praksi, kā arī izmantoja tiesnešu atsevišķo domu institūtu. Pētījuma rezultātā autore secina, ka personas tiesības iesniegt pieteikumu Satversmes tiesā tieši izriet no cilvēka pamattiesību kā subjektīvo tiesību aspekta. Pamattiesību aizskārums uzskatāms kā būtiskākais jeb primārais priekšnoteikums, lemjot par konstitucionālās sūdzības pieņemšanu. Būtisks un atsevišķos gadījumos pat izšķirošs ir subjektīvais faktors jeb personas subjektīvā pārliecība par to, ka un kad personai radies pamattiesību aizskārums. Autore arī secina, ka pašvaldības domes tiesības iesniegt pieteikumu Satversmes tiesā izriet no pašvaldības pienākuma nodrošināt noteiktās administratīvās teritorijas iedzīvotāju intereses. Savukārt, ievērojot Satversmes tiesas praksē noteikto tiesiskās stabilitātes principu, autoresprāt, pašvaldības domes tiesības iesniegt pieteikums par aktu, kas aizskar attiecīgās pašvaldības tiesības, būtu ierobežojamas ar termiņu. Paper analyzes infringement of fundamental rights as an essential part of application to the Constitutional Court of the Republic of Latvia. Author also analyzes infringement as a precondition of constitutional complaint of municipality. For better understanding of the theoretical and practical aspects, paper analyzes infringement as a precondition of application to the European Court of Justice and administrative courts in Latvia. In order to achieve the goal of this research, author broaches several assignments, such as exploring the jurisprudence and legal doctrine. As a result of this research author concludes that the right of a person to submit a constitutional complaint to the Constitutional Court of Republic of Latvia derives from the subjective aspect of fundamental rights. Infringement of fundamental rights is the prior precondition of constitutional complaint. In some cases the determinant factor is the conviction of a person wheter and when he/she started feeling the infringement. Author also concludes that the right of a municipality to submit an application to the Constitutional Court of the Republic of Latvia derives from the obligation of a municipality to ensure the rights and interests of its citizens. To ensure the legal stability author offers to restrict a term for the right of a municipality to submit an application to the Constitutional Court of Republic of Latvia.
