Darbā atspoguļots Senās Romas privāttiesību avotos regulētās apbūves tiesības saturs un kritērijs tās nodalīšanai no zemes nomas. Izvērtējot apbūves tiesībai radniecīgus lietu tiesību institūtus mūsdienās, konstatēta apbūves tiesības attīstība, kuras rezultātā pieļauta šādas tiesības nodibināšana uz augiem un dabā jau esošiem objektiem, tādējādi nodrošinot plašu institūta pielietojumu praksē. Izanalizējot Latvijas jaunāko tiesu praksi, konstatēti aktuālie problēmjautājumi svešas zemes tiesiskai apbūvēšanai, kas izriet gan no nepietiekamā un pretrunīgā normatīvā regulējuma, gan nekonsekvences tiesu nolēmumu motīvos. Darbā konstatētas nepilnības un potenciālā problemātika, kas varētu rasties pēc apbūves tiesības ieviešanas Latvijas Civillikumā. Un izvirzīts priekšlikums ieviest virszemes īpašumu kā atsevišķu īpašuma tiesību formu. Presented master thesis reflects the content of right of superficies and criterion to distinguish it from the land lease in ancient Rome’s legal system. Assessment of superficies related legal institutes in contemporary legal systems established that right of superficies has evolved as a right which can be created also on plants and existing objects, thus providing a wide range of practical application of the institute. Analysis of recent Latvian case-law relating to legal building on foreign ground, identified current issues, which arise from insufficient and contradictory regulatory framework and inconsistencies in motives of court rulings. Thesis also identifies gaps and potential problems that may arise after the introduction of right of superficies in the Civil Law of Latvia, on the basis of which author proposed to introduce superficies as a separate ownership right.
