Maģistra darbā ir analizēta viena no mūsdienu digitālā informācijas laikmeta problēmām – datornoziegumi. Darbā ir apskatīti un definēti datornoziegumi, to atšķirība no citiem informācijas tehnoloģiju noziegumiem, automatizētu datu apstrādes sistēmu saturs, tā papildināšana. Kā arī ir analizētas problemātiskākās noziedzīgā nodarījuma sastāva pazīmes. Tiek dots ieskats tiesu praksē un juridiskajā literatūrā pausto viedokļu analīzē. Darbā ir piedāvāts risinājums ieskatam un priekšlikumiem esošā regulējuma pilnveidošanai, datornoziegumu kvalifikācijas nepilnību novēršanai. Tiek pētīta šo noziegumu izmeklēšanas specifika un izteikti priekšlikumi tās uzlabošanai. Darbā tiek izmantotas šādas zinātniskās pētniecības metodes: salīdzinošā metode, salīdzinot tiesību normas ar autoru sniegtajām atziņām, sistēmiskā metode, pētot tiesību normu savstarpējo sasaisti un pazīmes to nošķiršanai un analītiskā metode, analizējot tiesas praksi un autoru atziņas un citus avotus. Darbā ir trīs daļas, kur pirmajā daļā tiek definēti datornoziegumi un noteikti, kuri noziedzīgie nodarījumi ir atzīstami par datornoziegumiem, otrajā daļā tiek analizētas datornoziegumu sastāva pazīmes, trešajā daļā tiks aplūkoti datornoziegumi no kriminālistiskā un kriminālprocesuālā aspekta, lai analizētu noziegumu izmeklēšanas specifiku un noteiktu nepilnības vai trūkumus tiesiskajā regulējumā. Master’s thesis analyzes one of the modern digital information age problems – computer crime. In the work is discussed and discribed definition of computer crime, the difference from another information tehnology crimes, automated data processing system content and possibility to improve it. As well as analyzes the problematic incrimination. It is an insight into case law and legal literature, analysis of views expressed. In the work is offered solution and proposals for improvement of the current framework, the cyber qualification failures. There are these crimes investigation of the nature and sets out proposals for improvement. This work used the following research methods: comparative method, compared with the law for the author to give an opinion, systematic method of studying the legislation and interlink signs of separation and analytical techniques for the analysis of the case law and authors' findings and other sources. Work is in three parts, where the first part is of the defined computer crime and to determine which offenses are recognized as computer crime, in the second part is the analysis of cyber constituent elements, the third part will deal with computer crime of the criminal aspect to analyze crime investigation specifics and identify gaps or regulatory bottlenecks.
