Starptautiskās komerciālās šķīrējtiesas procesā nav vienoti procesuāli noteikumi, kas regulētu ar pierādījumiem saistītus jautājumus, līdz ar to pastāvošā prakse attiecībā uz pierādījumu iegūšanu ir daudzveidīga. To īpaši ietekmē apstāklis, ka dažādos tiesību lokos izpratne par pierādījumiem atšķiras. Tas savukārt noved pie tā, ka attiecībā uz vienu no efektīvākajiem pierādījumu iegūšana veidiem – rakstveida pierādījumu izprasīšanu, starptautisko komerciālo šķīrējtiesu procesos valda nevienprātība un tā tiek dažādi realizēta. Bez tam neskaidrību šī pierādījuma iegūšanas veida realizācija rada augušā elektronisko dokumentu nozīme mūsdienu biznesa vidē. Pētījuma mērķis ir, analizējot šķīrējtiesas procesu regulējošās normas, ņemot vērā šķīrējtiesas procesa principus un mūsdienu tehnoloģiju attīstību, rast un skaidrot šķīrējtiesas procesam piemērotāko rakstveida pierādījumu izprasīšanas mehānismu. Darba rezultātā autors formulē visus rakstveida pierādījumu izprasīšanas procesa stadijas un norāda uz visefektīvāko, šķīrējtiesas procesam un mūsdienu tehnoloģiju līmenim atbilstošāko mehānismu, kā būtu veicama dokumentu izprasīšana. There are no generally recognized procedural rules in international commercial arbitration, therefore existing practice regarding evidentiary procedure varies from process to process. Main reason for that is the different comprehension regarding evidences between common law and civil law systems. Respectively, it leads to different understanding and realization of one of the most effective evidentiary procedure – document production. Moreover, confusion regarding document production procedure is made by growing importance of electronic documents in nowadays business environment. Aim of thesis is to find and explain the most suitable document production procedure for international commercial arbitration, by examining the applicable legal provisions to arbitration and by acknowledging the growing impact of technologies. Author explains all document production procedure steps and points out to most effective and most suitable document production procedure for the means of arbitration and technological development.
