Politisko partiju nelikumīga finansēšana

Abstract

Bakalaura darba tēma ir politisko partiju nelikumīga finansēšana. Darba mērķis ir analizēt Krimināllikuma 288.2 , 288.3 un 288.4 pantā paredzēto noziedzīgo nodarījumu sastāvu un to piemērošanas iespējas praksē, kā arī salīdzināt Latvijas regulējumu ar ārvalstīm. Lai gan politiskās partijas ieņem fundamentālu lomu demokrātiskā sabiedrībā, politisko partiju nelikumīga finansēšana Latvijā ir maz pētīts temats. Bakalaura darba uzdevumi ir izskaidrot terminus “politiskā partija” un “politisko partiju apvienība”, analizēt minētās Krimināllikuma normas, identificēt iespējamās problēmas šo normu piemērošanā, kā arī aplūkot ārvalstu tiesisko regulējumu politisko partiju nelikumīgas finansēšanas jomā.

Bachelor thesis is the illegal financing of political parties. The aim of this work is to analyse Article 288.2, 288.3 and 288.4 of the Criminal Law, identify situations in which these articles should be applied, as well as to compare the Latvian legislation with the legislation in other countries. Although political parties have a fundamental role in a democratic society, illegal financing of political parties in Latvia is not a studied enough topic. The tasks of this work are to explain the terms "political party" and "alliance of political parties", analyze said provisions of the Criminal Law, identify possible problems that may accrue when applying these articles, as well as to examine the legal framework of illegal financing of political parties in other countries.
